ORDINANCE N0. 638
AN INTERIM ORDINANCE OF THE COUNTY OF BUTTE,
STATE OF CALIFORNIA, ZONING A PORTION OF SAID
1 COUNTY, REFERRING TO EXISTING ORDINANCE NOS.
1.'15 AND 522 OF SAID COUNTY AND DECLARTNCr AN EMERGENCY

'~ The Board of Supervisors of the County'of Butte, State of
California, do ordain as follows:

SECTION 1. The hereinafter described area situate in the
~5 County 8f Butte, State of California,~:ishall be zoned as an
1°R-1°t Residential District as hereinafter described and subject
',6 to all of the restricted uses applicable to an TAR-1" District,
said area so zoned being located southwezt of the City of Chico,
7 California, described as; follows:
'8 Beginning at a point on the centerline of Dayton Road
three hundred and thmrty (330) feet north of Orchard
'9 Lay; thence easterly and parallel to Orchard L~Iay to a
point three hundred and seventy (370) feet east of
10 ."~.=~rnDiamond Avenue to Edgar Slough; thence westerly along
Edgar Slough to centerline of Dayton Road; thence
11 northerly along centerline of Dayton Road to the point
of beginning.

SECTION 2. The following regulations shall apply in an
13 ~'R-1't Residential District:
I4 2.1 Uses Permitted:
15 1). Single-family dwellings.
2). Accessory buildings.
16 3)• The following uses subject to securing a Use
Permit in each case:
iJ.7 a). Golf courses and country clubs.
b). Public and quasi-public uses, including
18 churches, fire houses, hospitals, parks and
playgrounds, schools and public utility build-
]9 ings .
c). Private stables.

2.2 C~uilding Site Area Required: Eight thousand one hundred
21 twenty-five (8,125) sq. ft.
22 2.3 Niinimpxn Buildings Site G+~idth Required: Sixty-five
(65) feet.

2.1N Front Yard Required: Twenty--five (25) feet,

2.5 Side Yard Required: Six (6) feet, unless building
25 site is less than sixty (b0) feet in width, in which case
side yards equal to ten (10) per cent of such width, but
26 not less than five (5) feet shall be required.
2'7 SECTION 3. The penalties for the violation of the zoning
hereby imposed upon said district shall be as provided in the
' 28 said Zoning ~abling Ordinance.
~9 SECTION 1~.. The ordinance shall be, and it is hereby de-
Glared to be in full force and effect from and after the date
30 of its passage, pursuant to the emergency hereinafter found and"
declared; and it shall remain in full force and effect until
31. such. time as a permanent ordinance covering the above-described
area shall take eff ect following notice, public hearings, and
32 other procedures as are provided in said Zoning Enabling Or-
dinance, or until such. time as the Board of Supervisors shall
determine that the said area shall not be zoned as an r~R-1't
District.

SECTION 5. For "the immediate preservation of the public
peace, health and safety of the area hereinabove described, and
the residents and inhabitants thereof, it. is necessary that this
ordinance take effect immediately. A declaration of the facts
constituting the necessity therefor is as follows:
The Adoption of such Interim Zoning Plan is necessary
in the public interest, to maintain the status quo
in such district pending the determination of the
application .for such permanent detail zoning.
SECTION 6. This emergency ordinance shall take effect im-
mediately upon its passage and before the expiration of fifteen
{15) days after its passage shall be published once, with the
names of all members voting for and against the same, in the
Chico Enterprise Record, a newspaper published in said County
of Butte.
ADOPTED and PASSED by the Board of Supervisors of the Cotu~ty
of Butte, State of California, this 16th day of February, 1959,
by the following vote:
AYES: Supervisors Alldredge, G31es, Huggins, Pryde and Chairman Kepple
NOES : None
ABSENT: None
NOT VOTING: None
