HomeMy WebLinkAbout64-002 RESOLUTION NO. 64- BOARD OF SUPERVISORS COUNTY OF BUTTE, STATE OF CALIFORNIA RESOLUTION OF ABANDONMENT OF BUTTE COUNTY HIGHWAY WHEREAS, the Board of Supervisors of the County of Butte, State of California, heretofore declared its intention to vacate and abandon the following described public highway of the County of Butte, That portion of Slate Street, lying between the east line of Laurel Street (Skyway) and the west line of Fir Street, and that part of Fir Street between the south line of Mica Street and the north line of Lava Street as said streets are shown on that certain map of Stirling City, filed in the office of the Recorder of the County of Butte, State of California, August 3, 1903, in Map Book 4, page 33, subject to the following described drainage easement; Beginning at the most southerly corner of Lot 1, Block 12; thence northeasterly along the southerly line of said Lot 1 and its extension to the easterly line of Fir Street; thence southeasterly along said easterly line 20.00 feet; thence southwesterly parallel to and 20.00 feet southerly of the southerly line of Lot 1, Block 12, to the easterly line of Laurel Street (Skyway); thence along said Laurel Street northwesterly 20.00 feet to the point of beginning. RESERVING AND EXCEPTING from the abandonment the easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers, utilities, storm drains and appurtenant structures in, upon, over and across said property. WHEREAS, upon filing Resolution of Intention to abandon said highway, the Board of Supervisors did, by order, fix the 14th day of January, 1964-, at 1:30 o'clock, P.M. , at the Butte County Courthouse, Oroville, California, as the time and place for a public hearing; and WHEREAS, notice of said hearing was given to all freeholders of the district in which said highway is located by publication for two successive weeks prior to the date of said hearing, in the Chico Enterprise-Record, and by the posting of similar notice along the line of the highway proposed to be abandoned; and WHEREAS, it appears that all legal requirements have been complied with, and the Board, being fully informed and advised, -1- finds that the highway described in said Resolution is unnecessary for present or prospective public use; NOW, THEREFORE, BE IT RESOLVED, that the public highway as above described is hereby ordered vacated and abandoned. The County Clerk is hereby directed to file a certified copy of this Order in the office of the County Recorder of Butte County, for record. The foregoing Resolution was Passed and Adopted on the 14th day of January , 1964, by the following vote: AYES: Supervisors Giles, Pryde, Steinegger and Chairman Steinegger NOES: None ABSENT: Supervisor Alldredge il .
