HomeMy WebLinkAbout64-003 11 • 1 RESOLUTION No. 64-3 2 BOARD OF SUPERVISORS 3 COUNTY OF BUTTE,, STATE OF CALIFORNIA 4 RESOLUTION ESTABLISHING LOCAL APPEALS BOARD OF THE COUNTY OF BUTTE AS PROVIDED UNDER STATE HOUSING LAW 5 (Health and Safety Code Section 17920.5) 6 7 Be it resolved by the BOARD OF SUPERVISORS of the County 8 of Butte, State of California, as follows: 9 1. That in accordance with Section 17920.5 of the 10 Health and Safety Code of the State of California, there is hereby 11 established in the County of Butte a "Local Appeals Board," which 12 is authorized to hear appeals regarding the building requirements 13 being enforced by the County of Butte. 14 2. That said Board shall consist of seven (7) members 15 who are to be appointed by the Board of Supervisors for a term 16 of two (2) years. In making such appointments the Board shall 17 consider representation on said Board from the following general 18 categories: 19 (a) Attorneys at Law 20 (b) General Contractors 21 (c) Electrical Contractors 22 (d) Plumbing Contractors 23 (e) Agriculturists 24 (f) General Public at Large 25 3. The Local Appeals Board shall hear appeals brought 26 by any person as to the application of any rule or regulation 27 being enforced by the Department of Public Works of the County 28 of Butte, under any facts and circumstances presented to the 29 Local Appeals Board by such person alleging that the application 30 or enforcement of any such rule or regulation by the Department of 31 Public Works under such facts and circumstances is an erroneous 32 or unlawful application or enforcement of such rule or regulation -1- 1 by the Department of Public Works. 2 4. The decision of the Local Appeals Board is final 3 except for such action as may be taken by a court as permitted 4 or required by law. 5 5. The Local Appeals Board shall determine its quorum 6 and all of its meetings shall be open to the public. 7 6. All records of the Local Appeals Board shall be 8 open to inspection by the public during regular County office 9 hours.
