COUNTY OF BUTTE, STATE OF CALIFORNIA
RESOLUTION REFORMING CONTRACT OF APPOINTMENT

OF SEALER OF WEIGHTS AND MEASURES

4: WHEREAS, the BOARD OF SUPERVISORS of the County of Butte
5 did by Ordinance No. 749, effective September 1, 1962, grant a
6 cost of living increase and other benefits to all County
7 employees; and
8 WHEREAS, prior thereto, a County officer and employee had
9 been appointed for a definite four-year term, to wit, the
10 Sealer of Weights and Measures; and
11 WHEREAS, a question has arisen as to the intent of said
12 BOARD OF SUPERVISORS at the time of the appointment of said
13 County officer and employee as to whether or not he was to
14 receive the blanket cost of living increases and other benefits
15 granted to all employees of the County of Butte, during their
16 respective terms of office; and
17 WHEREAS, it was not generally considered at the time of
18 the appointment of the Sealer of Weights and Measures as to
19 whether or not the constitutional prohibition against an increase
20 in salary during a fixed term was effective, having been
21 suspended in the years prior thereto, and the appointment of
22 said Sealer of Weights and Measures having been made in the
23 year 1962 and in close proximity to discussions concerning the
24 possibility of a general increase to be granted to all County
25 employees;
26 NOW, THEREFORE, IT IS HEREBY ORDERED AND RESOLVED by the
27 BOARD OF SUPERVISORS of the County of Butte, State of California,
28 as follows, to wit:
29 1. That the said Board was not advised that the Sealer
30 of Weights and Measures was at the last step of the pay scale
31 of the range within which said Sealer of Weights and Measures
32 was appointed, and that he would not be in a position to receive

1 any increase in compensation during the term of his appointment,
2 and that if said Board had been acquainted with the situation
3 they would have considered the problem of providing for such
4. an increase.
5 2. That this Board desires to reform the appointment
6 records to increase the Sealer of Weights and Measures from his
7 present pay of $542.00 per month to the pay of $605.00 per
8 month, and that said increase shall be effective as of
9 January 1, 1964, and shall continue for the term of the
10" appointment.
11' 3. That the Clerk of the County of Butte shall reform
12 the appointment records of the Sealer of Weights and Measures
13 by attaching a copy of this Resolution thereto.
14 4. That the County Counsel is directed to forward a
18 copy of this Order and Resolution to the Attorney General of
16 the State of California, with a request for an informal opinion
17 confirming the legality of the reformation of the contract
18 herein ordered and the payment of the salary and other benefits
19. in accordance with the reformed contract from the effective date
20 of the ordinance granting such salary increases and other
21 benefits above mentioned.
22 PASSED AND ADOPTED by the BOARD OF SUPERVISORS of the
23 County of Butte, State of California, this 4th day of
24 February , 1964, by the following vote:
25 AYES: Supervisors Giles, Steinegger and Chairman McKillop
26 NOES: None
27 ABSENT: Supervisors Alldredge and Pryde
