HomeMy WebLinkAbout64-050Copies given to Auditor, Administrai~ive Officer and Countq Counsel ,` RESOLUTION N0. 64-50,: 1 BOARD OF SUPERVTSORS 2 COUNTY 0~' BUTTE, STATE OF CALIFORNIA 3 RESOLUTION AMENDING PERSONNEL RESOLUTION No. 625 4: S WHEREAS the Board of Supervisors of the County of Butte, 6 State of California, has heretofore amended the Code of the County 7 of Butte providing for the addition of the word "demotions', in 8 conjunction with the word "discharge"; and 9 r~IEREAS, it is deemed to be in the best interests of the 10 morale of the employees that this provision be made, 11; NOW, THEREFOR, BE IT RESOLVED by the BOARD OF S[TPERVISORS 1.2 of the County of Butte, State of California, that the personnel: 13 resolution No. 625, and the respective sections, be amended as L4 follows: 15, Section: i6 2.2 APPEAL 17~ A written statement by a person who declares in his state- 1$ went his belief that he was discharged ar demoted without reason- 19, able cause. 2Q.: 2.18 REASONABLE CAUSE 21. The condition or conditions existing which may justify the 22 discharge or demotion of any employee. Such conditions for dis- 23 ' charge may;i.nclude but shall not necessarily be limited to un- 24. satisfactory performance, in-subordination, persistent failure to 25 get along with other persons, unauthorized absence from duty, 28 inability to do satisfactory work because of ill health or fraud- 27 ulent employment applications. Such conditions which may justify 2~ involuntary demotion, may include but shall not necessarily be 2..9; limited. tounsatisfactory performance, physical incapability in 30; performing the work, abolishment of the classified position or 3:7; re-classification of the position to a lower classification. 3$; 2.19 REGULAR STATUS The: status of an employee following the completion of his 1 2 3: 4 S 6 ~' _ 8 9 10; ~~ a~a 1.3' 14. 15s 16s 17: 2 19 20 2i 22: 23. 24: 25 28 2:7, 28. 2.9 3vQ; 3:1: $2; probationary period which entitles him to appeal his discharge or demotion which he believes was made without reasonable cause. 6.3 APPLICATION 0~' RATES Employee shall be paid a salary within the monthly range ar rate or equivalent hourly rate established for the class or posit- ion to which he has been appointed as provided in the salary ordinance. No regular employee shall be paid at a lesser rate than for which he was appointed unless he has been issued a notice of demotion at least 10 working days in advance, stating the reason and causes for such reduction. 8.2 STATUS OF NE~nT EMPLOXEES A new employee shall be on probation during the first six months of his employment. During this probation period the depart- ment head shall observe the employee's ability to work. If at the end of the probation period the department head believes the employee is doing his work satisfactorily he shall inform the employee and the personnel director. The employee shall then have regular status and may enjoy such privileges regarding appeal from discharge or demotion which are set forth. in ordinance 792 in section 8.9 of these rules. The status of the `~Telfare Department employees shall be that which is provided for by this resolution or by the rules of the Welfare Merit System of the State of Calif- ' ornia. DEMOTION An employee may be demoted by a department head only for reasonable cause. Reasonable cause may include but shall not necessarily be limited to one or more of the following situation: 1. Unsatisfactory performance 2. Physical incapability to do the work 3. Abolishment of the classified position 4. Reclassification o~ the position to a lower class. -2_ _ _ iii 1 Section: 2 8.7B NOTICE OF DEMOTION 3 Shen a department head believes he has reasonable cause for 4 demoting a regular employee he shall give the employee a written 5 notice of demotion, specifying the reason or reasons for the de- b motion as well as the wages and duties of the new position. Such 7 notice shall be given at least 10 days prior to the effective date 8 of the demotion. One copy of the .notice shall be given to the 9 employee, one copy to the personnel director, which shall be place 10 in the employee's record. The department head may retain the thin 11 copy, 12 8.8 APPEALS COMMISSION 13 At the beginning of each fiscal year the Board shall appoint 14 an Appeals Commission of three persons to serve for the fiscal year. 15 Butte Covnty Employees' Association shall nominate one member - The 16 Administrative Council shall nominate a second member - two members 17 so nominated shall in turn nominate a third member. The purpose of 18 the Appeals Commission shall be to hear an appeal from a discharged 19 or demoted employee. If a member of the Appeals Commission is in- 20 volved in a particular appeal he shall be disqualified from parti- 21 cipating in that appeal. In such event, the Board shall appoint a 22 temporary member of the commission to hear the appeal. The nomin- 23 acing process shall be the same as specified in this section. 24 8.9A A~'P :ALS P~20CEDURE 25 Appeal - ~~tithin 20 days after he has received notice of dis- 26 charge or demotion, an employee who has regular status may submit a 27 written appeal to the personnel director. The personnel director 28 shall immediately notify the .appeals commission and schedule a hear 29 ing for the appeal to be heard by the commission within 20 days. 30 The personnel director shall submit to the appeals commission copie 31 of the notice of discharge or notice of demotion and the employees 32 appeal and notify all parties of the time and place of the hearing. -3- B 7 8 9 10' 11 12 13 14 15 16 17 i8 19 20 21 22 23 24 25 26 27 28 29 30 3 ~. 32 Section 8.9C FINDINGS AND REPORT At the conclusion of the hearing the Appeals Commission shall make an official finding as to whether or not in the opinion of the Commission the employee was discharged or demoted for reasonable cause. 'Whether or not the Commission finds there was reasonable cause for the discharge or demotion, the Commission may malce any recommendations it believes desirable to the employee and. or the department head, personnel head, administrative office and the Board regarding the circumstanceso Such recommendations may concern any of the following points; eligibility for the future employment of the employee with the County; reinstatement to the position from which he was discharged or demoted; suspension of the employee for a specific period of time, or any other pertinent- -matter. A copy of the Commissiori''s report shall be given to the employee, the department head, the personnel director for place- ment in the employee's file and filed with the Clerk of the Board as a matter of public record. Any action of "the Appeal Commission shall be final and not subject to judicial review.
