HomeMy WebLinkAbout64-073RESOLUTION NO. 64-,~~' BOARD OF SLiPERVISORS ; 1 2 3 4 5 6 7 8 9 10 11 '12 13 14 15 16 I7 ': 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 COUNTY OF BUTTE, STATE OF CALIFORNIA RESOLUTION AUTHORIZING ACQUISITION OF REAL PROPERTY BY EMINENT DOMAIN NECESSARY FOR THE CONSTRUCTION OF A, COUNTY HTGHWAY KNOWN AS OROVILLE GRIDLEY HIGH4TAY TN THE COUNTY OF BUTTE, STATE OF BE IT RESOLVED by the BOARD OF SUPERVISORS of the County of Butte, State of California, that said Board finds and determines and hereby declares, as follows, to wit: 1. That public interest and necessity require the acquisit- ion, construction and completion by the County of Butte, of a public improvement, namely a County Highway known as Oroville Gridley Highway, in the County of Butte, State of Calif ornia. 2. That public interest and necessity require the acquisit- ion for said improvement of the real property, or interest in the real property hereinafter described, together with all improvements situate thereon, and it is hereby found and determined that the construction of a County Highway is a public use, authorized by law, and that public interest and necessity require the construct- ion of said improvements and the acquisition of said real property hereinafter described, and all improvements situate thereono 3. Said proposed public improvement is planned and located in a manner which will be most compatible with the greatest public good. and the least public injury. 4. That the County Counsel of the County of Butte is hereby authorized and empowered as follows: i (a) To acquire, in the name of the County of Butte, a ;fee simple estate or such necessary interests in and to th e ;hereinafter described real property, or interest in real property, :and all improvements thereon by condemnation in accordance with the provisions of the Streets and Highways Code, Cade of Civil Procedure and the Constitution of the 'State of Californian relat- ing to eminent domain. (b) To prepare and prosecute for the County of Butte such 1 2 3 ,4 5 6 7 8 ', : 9 10 ill 12 13 14 '15 16 17 18 19 20 '21 22 23 24 25 ', 26 27 ,28 29 30 31 32 proceedings in the proper court having ,jurisdiction thereof and make such deposits from County funds for fees and costs as are necessary for such acquisition. (c) To make application to said court for an order fixing the amount of security in the way of moneys deposited as said court may direct, and far an order permitting the County of Butte to take immediate possession and use of said real property, or interests, or improvements in said real property, as a right of Tway for a public highway .for public use. (d) To make deposit of such security out of proper funds under the control of the County of Butte, in such amounts as fixed and determined and in such manner as said court in which condemn- anon proceedings are pending may direct, and the Auditor is authorized to make said deposit immediately upon the court making said order. 5. The real property or interest in real property, and/or improvements thereon, which the County of Butte is, by this Resolution, authorized to acquire for said public improvements in fee simple, is situate in the County of, Butte, State of California, more particularly described as follows: Commencing at the southwest corner of Section 33, T18N, R3E, MllB&M; thence N 89°09'00" E 13.64 feet; thence N 55° 38'00" E 1255.96 feet; thence along the arc of a 1500.00 foot radius curve, concave to the, south through a central angle of 64°46'40", an arc length. of 1695.88 feet; thence non-tangent to said curve N 30°24'40" E 50.00 feet to, the trse point of beginning of `.this description; thence 859° 35'20" E 614.21 feet; thence along the arc of a 1450.00 foot radius curve, concave to the north, through a central angle of 31623'i9", an are length of 794.36 feet; thence N 89°01'21" E 323.25 feet; thence S 00°58'39" E 31x00 feet to the existing northerly right of way line of said exist- ing Oroville-Gridley Highway; thence 5 89~01'21/4~I 8$6.45 feet; thence along the arc of a 367.00 foot radius curve and along said right-of-way line, concave to the north, through a central angle of 45°21'19", an arc length of 290.52 feet; thence N 45°37'20" ~7 97.31 feet; thence along the arc of a 1183.00 foot radius curve and along said exist- ing right-of-way line, concave to the southwesfi, through a central angle of 13°58'00'+, an arc length of 288.37 feet; thence N 59°35'20" W along said existing right-of-way line 298.82 feetq thence along the arc of a 367.00 foot radius curve and along said existing right-of-way line concave to the northeast through a central angle of 43°08'00", an 11i 1 arc length of 276.28 feet; thence N 1627'20" T~ along said existing right-of-way line 164.83 feet; 2 thence along the arc of a 433.00 foot radius curve and along said existing right-of-way line, concave to the 3 southwest through a central angle of 22~55'S8", an arc length of 173.31 feet to a point of cusp; thence S 39~ 4 23'18" E 608.88 feet to the true point of beginning of this description.
