HomeMy WebLinkAbout64-0761 ~{ ~. - 1 ~ RESOLUTION NO. 64- 76 2 BOARD OF SUPERVISORS 3 COUNTY OF BUTTE STATE OF CALIFORNIA 4 RESOLUTION AUTHORIZING COUNSEL FOR THE COUNTY OF BUTTE TO APPEAR AS AMICUS CURIAE 5 WHEREAS, Feather River Railway Company and Georgia 6 Pacific Corporation on or about the 16th day of July, 1964, filed 7 a suit in the United States District Court to halt any interference 8 with the railroad's operation by the Department of Water Resources; 9 and 10 WHEREAS, County very much desires that the relocation 11 of the Oroville-Feather Fa11s Road be along the "D" alignment 12 which generally parallels said railroad east of the South Fork 13 Bridge, and which County road will be accommodated by a joint 14 railway--County highway bridge as said railway is relocated; and 15 WHEREAS, the County of Butte determines and finds that 16 public convenience and necessity would best be served by the 17 relocation of the Oroville--Feather Falls Road along the "D" 18 alignment rather than any other proposed route for replacement 19 of said road; and 20 WHEREAS, it is imperative that a replacement for said 21 Oroville-Feather Falls Road be commenced forthwith if traffic 22 between Oroville and Feather Fa11s is not to be interrupted by 23 the inundation of the present County road, which will occur in 24 the winter of 1956-67; 25 NOW, THEREFORE, be it resolved by the Board of 26 Supervisors of the County of Butte, State of California, as 27 follows: 28 1. That legal counsel and attorneys for said County 29 are hereby authorized and instructed to appear on behalf of 30 County as amicus curiae, or in any other capacity deemed 31 advisable by said counsel, for the purpose of implementing the 32 -1- ,. ~~ 1 relocation of the Feather River Railway, which will make possible 2 the relocation of the present Oroville-Feather Falls Road along 3 the "D" alignment and generally parallel with, and using the same 4 bridge as, said Feather River Railway. 5 2. That any and all steps be taken. by said counsel g and attorneys to accelerate the construction of said railway, q said County highway and said jointly used bridge so that rail 8 and road traffic between Oroville and Feather Falls will be 9 uninterrupted by inundation of present rail and highway facilities. 10 3. That a copy of this resolution be forwarded to 11 William E.
