RESOLUTION 64-90
OF THE BOARD OF SUPERVISORS
AU'T`HORIZING AN AMENDMENT TO CORRECT AN ERROR IN THE CONTRACT BETWEEN SAID
COUNTY OF BUTTE AND THE
STATE EMPLOYEES' RETI.RBtiN~NT SYSTEM
WHEREAS, The Board of Supervisors of the County of Butte entered into contract
effective April 1, 191:5 ~ th the Board of Administration, State ~nployees'
Retirement System, and
WHEREAS, The Board of Supervisors subsequently by Ordinance No. 821 approved an
amendment to said contract increasing the allowances for persons already
retired under said contract in accordance with Section 21251.6 of the
Retirement Law, and
WHEREAS, the amendment adopted by said Ordinance through error provides that the
amendment shall be effective Septe:ber 16, 1964, and
WH~tEAS, it was the intention that the increase in allowances payable under said
amendment become payable October 1, 1964 (instead of September 16, 1964),
and
WHEREAS, Section 20461 of the State Employees' Retirement Law p mvides that errors
in a contract may be corrected through amendments approved by the adoption
of suitable resolutions by the contracting parties,
NOW, THEREFORE BE IT RESOLVED, that said Board of Supervisors of the County of
Butte does hereby authorize the following amendment to said contract:
A, Section 21251.6 of the Government Cod® (providing for increases in
allowances to persona retired prior to January 1, 1962) shall apply
to allowances payable for time commencing on the first da of the
calendar month coincidin with or next followin the effective date
BE IT FURTHER RESOLVED, that the presiding officer of said Board of Supervisors be,
and he is hereby authorized, empowered, and directed to execute said
amendment for and on behalf of said Board of Supervisors.
Adopted this 25th day o£ August 1964 .
