HomeMy WebLinkAbout64-093RESOLUTION N0, 64-93 BOARD OF SUPERVISORS RESOLUTION RFiQUESTING INTERSTATE COMMERCE COMMISSION TO GIVE PROMPT CONSIDERATION TO PETITION FOR RECONSIDERATION OF REPORT AND ORDER DIRECTING RELOCATION OF FEATHER RIVER RAILROAD WHEREAS, Division 3, of the Interstate Commerce Commission, by report and order in Finance Docket No. 22060, and related proceedings, served January 24, 1964, found that, subject to certain conditions for the protection of railway employees, the present and future public convenience and necessity (1) permit abandonment by the Feather River Rail- way Company of a portion of its line of railroad extending from Land to Craig upon the commencement of operations over a new line to be constructed between Craig and Palermo by the State of California, (2) require the acquisition and operation of, or the operation over, a line of railroad to be constructed by said State of California between Craig and Palermo by the Feather River<Railway Company, (3) re- quire the operation by the Feather River Railway Company of the former line of railroad of the Western Pacific Railway Company permitted to be abandoned in Finance Docket No, 216og, and now owned by the State of California together with such substitute fACilities as may be furnished by said State, between Land and Intake, and (~-) permit abandonment by the Feather River Railway Company of its operation of the said former line of railroad of the Western Pacific 1. Railway Company between Land and Intake upon the commence- ment of operation over the line to be constructed by the State of California between Craig and Palermo, all in Butte County, California, as described therein, and that the present and future public convenience and necessity have not been shown to permit the abandonment by the Feather River Railway Company of its entire line of railroad extending from Land to Feather Falls, in Butte County, California; and WHEREAS, the I}epartment of Water Resources of the State of California has petitioned the Interstate Commerce Commission for reconsideration of said report and order; and WHEREAS, the Board of Supervisors of the County of Butte has heretofore determined and found that public convenience and necessity would best be served by the reloca- tion of the Oroville-Feather Falls Road, a County highway, over a bridge to be jointly used by said Feather River Rail- road Company and the County of Butte and the alignment of said County highway to generally follow the alignment of said relocated railroad line; and WHT3REAS, the Board of Supervisors of the County of Butte, State of California, has heretofore found that it is imperative that a replacement of said Oroville-Feather Falls Road be commenced forthwith if traffic between Oroville and Feather Falls is not to be interrupted by the inundation of the present County road, which will occur 'in the winter of 1966-67; 2. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California: 1. That the Board does hereby express its urgent desire: (a} That the Commission act expeditiously in its consideration of said petition for reconsideration in order that a final determination of the proceedings involved in Finance Docket No. 22060, and embraced proceed- ings, might be promptly effective; (b} That the Commission either decline to reconsider or that it affirm the findings and order in Division 3, in Finance Docket No. 22060, and embraced pro- ceedings, in said report, inasmuch as this Board believes that these findings and order correctly dispose of the issues of public convenience and necessity raised by the applications involved therein; 2. That a copy of this resolutian be forwarded to the Interstate Commerce Commission, Washington, D.C.
