ASSESSMENT DISTRICT
RESOLUTION N0. 6~-ii4
(1) DETERMINING THAT THE PUBLIC CONVENIENCE
AND NECESSITY REQUIRE ZMPROUEMENTS AND
ACQUISITIONS TO BE MADE AND PAID ~'OR BY
SPECIAL ASSESSMENTS, AND
(2) DETERMINING THAT THE SPECIAL ASSESSMENT
INVESTIGATION, LIMITATION AND MAJORITY
PROTEST ACT OF 1931. SHALL NOT APPLY TO
PROCEEDTNGS THEREFOR.
WI~REAS, on August 11, 1964, this Board adopted
RESOLUTION N0. 64-85
(1) Describing Proposed Improvements and
Acquisitions for Proposed Shasta Union
Drainage Assessment District,
(2) Declaring that Public Convenience and
Necessity Require Said Improvements and
Acquisitions, and
(3) Setting Time and Place for a Hearing
Respecting the Public Convenience and
Necessity for said Improvements and
Acquisitions
and

WHEREAS, this Board set September 1, 1964 in said
Resolution No. 64-85 as the date for hearing all persons interested
in the matters contained in said Resolution No. 64-85, and
WHEREAS, on September 1, 1964 this Board beard numerous
persons who spoke either for or against the proposed improvements
described in said Resolution No. 64-85 and for or against other
matters contained in said resolution and on that date this Board
received written protests from numerous persons, and
WHEREAS, the Clerk of this Board has filed her affidavit
showing that on August 17, 1964, she mailed a notice to each property
owner in said Shasta Union Drainage Assessment District stating the
time and place of a hearing on the matters contained in said Resolution
No. 64-85, and containing all other matters this Board directed the
Glerk to include in said notice, and
WHEREAS, the Ccunty purveyor-Director of Public Works has
filed his affidavit showing that during the period commencing
August 17, 1964 and ending on August 21, 1964, he caused notices to
be pasted on the streets in said Shasta Union Drainage Assessment
District stating the time and place of a hearing on the matters
contained in said Resolution No. 64-85 and containing all other
matters this Board directed said County Surveyor-Director of Public
Works to include in said notice, and
WHEREAS, on August 18, and August 19, 1964, the Clerk duly
published in the Chico Enterprise-Record a notice stating the time
and place of a hearing on the matters contained in said Resolution
No. 64-85 and containing all other matters this Board directed the
Clerk to include in said notice and an affidavit of the said Chicc
Enterprise-Record has been filed showing said publication was done on

said dates, and
WHEREAS, certain property owners whase names are shown in
the minutes of this Board filed objections to the matters this
Board determined in said Resolution No, fi4-85, and
WHEREAS, this Board has heard all persons so objecting that
desired to be heard and has considered all such objections,
NOON THEREFORE
RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF
BUTTE, STATE OF CALIFORNIA:
1. That this Board finds that each of the recitals stated
above is true.
2. That this Board finds and determines that the public
convenience and necessity require that the County of Butte do the
work and construct the improvements that are described or referred
to in Resolution No. 64-85 adopted by this Board on August 11, 1964,
together with any necessary changes thereto, and that the County of
Butte acquire the rights of way, places and properties that are
described or referred to in said Resolution No. 64-85, together
with any necessary changes thereto, and that the Gounty of Butte
shall do said work and construct said improvements and that the
Gounty of Butte shall acquire said rights of way, places and properties
all in and adjacent to an area in the County of Butte that this
Board in said Resolution No. 64-85 has designated Shasta Union
Drainage Assessment District.

3. That this Board determines that the work, improvements,
and acquisitions referred to in paragraph 2 of this Resolution and
any changes thereto shall be paid for by special assessments levied
on lands in said Shasta Union Drainage Assessment District except
for all costs thereof which are paid for by the County of Butte, and
that this Board determines that none of the provisions of the
Special Assessment Investigation, Limitation and Majority Protest
Act of 1931 shall apply to the proceedings wherein said work and
improvements are done and said acquisitions are made and the special
assessments theref or are levied.
4. That this Board determines that the work and improvements
and acquisitions and special assessments therefor and all proceedings
for the same shall be done pursuant to the terms and provisions
of the Improvement Act of 1911.
5. That tlv.s Board hereby denies all objections filed and ~-
presented respecting the matters contained in said Resolution No. 64-85.
PASSED AND ADOPTED BY THE BOARD OF SUPERVISORS OF THE GOUNTY OF
BUTTE, STATE OF CALIFORNIA, THIS 22nd DAY OF SEPTEMBER, 1964, by'
the following vote:
AYES: SUPERVISORS GILES, PR'YDE, STEINEGGER AND CHAIRMAN MC KILLOP
NOES: SUPERVISORS NONE
ABSENT: SUPERVISORS NONE
NOT VOTING: SUPERVISOR ALLDREDGE
