RESOLUTION N0. 64-126
A RESOLUTION REFERRING PETITION TO
COUNTY CLERK AND DIRECTTNG GIVING NOTICE OF
HEARING ON INCORPORATION OF PROPOSED
MAGALIA COUNTY WATER DISTRICT
RESOLVED, by the Board of Supervisors of the County of
Butte, State of California, that
WHEREAS, a petition for the incorporation of the proposed
Magalia County Water District, consisting of two counterparts,
has been filed with this Board, pursuant to the provisions of the
County Ulater District Law, Division 12 of the 6~7ater Code of the
State of California, praying that certain territory, more parti-
cularly described therein, be incorporated as a County [dater Dis-
trict under and pursuant to the provisions of the County Water
District Law;
WHEREAS, the County Clerk is the person designated by law
to determine whether or not the petition for the incorporation of
the proposed district is signed by a sufficient number of voters
to qualify said petition; and
WHEREAS, the County Clerk is designated by the County Ulater
District Law as the person to give notice of hearing on the incor-
poration petition, in the event the petition does qualify;
NOG1, THEREFORE, BE IT RESOLVED and ORDERED, as follows:
1. That the petition for incorporation of Magalia County
Water District be referred to the County Clerk of the County of
Butte to determine whether or not said petition is signed by an
adequate number of voters to qualify said petition, pursuant to
the provisions of the County Water District Law, Division 12, of
the Water Code of the State of California
2. That, in the event said County Clerk determines that
the petition for incorporation of the Magalia County tidater Dis-
trict does qualify pursuant to the provisions of said County ?F7ater
District Law, the County Clerk shall give notice of hearing on the

proposed incorporation by publication of a notice of hearing on
the formation petition once a week for at least two weeks before
the time when the petition is to be presented to, and considered
by, this Board in one newspaper printed and published in the
County.
3. That, upon giving notice of hearing, the County Clerk
shall also cause a notice to property owners of the filing and of
the time and place of the hearing of the petition for incorpora-
tion of the Magalia County 6dater District to be mailed at least
fifteen days prior to the date fixed for hearing on the petition,
pursuant to the provisions of the Government Code, Sections 53520
through 53523, inclusive, of the Government Code.
4. That, upon giving notice of hearing, the County Clerk
shall also ascertain from the County Assessor whether any owner
of real property, including property assessed by the State under
Section l~€, Article XIII of the California Constitution, has
filed with the County Assessor, during the current fiscal year, a
statement of his name, address and a description of the property
owned by him requesting that a notice of all proposals affecting
such property shall be mailed to him, pursuant to the provisions
of the Government Code, Section 58905, of the Government Code of
the State of California and, in the event such statement has been
filed, that the County Clerk be, and is hereby, instructed to
mail notice of the filing of said petition to said owner, pursuant
to the provisions of Sections 58900 through 58908 of the Govern-
ment Code of the State of California.
