A RESOLUTION DETERMINING THAT THE PUBLIC INTEREST
AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN
LAND AND DIRECTING THE FILING OF EMINENT DOMAIN
PROCEEDINGS
RESOLVED, by the Board of Supervisors of the
County of Butte, ,
State of California, that,
WHEREAS, it is the intention of this County ____ to
construct and maintain drainage facilities,
in and on the land hereinafter described,
NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDE RED as
follows:
1. That the public interest and necessity require the
acquisition, construction and completion of _ drainage facilities
and work auxiliary-thereto, in, over, across
and. upon the parcels of land more particularly described in Exhibit "A",
attached hereto and by this reference made a part hereof, within said °
County of Butte , and the taking of an easement
therefor
is necessary
for said improvements.
2. That said proposed acquisition(s) and improvement(s) are
planned.-and located in the manner which will be most compatible with the
greatest public .good and the least private injury, and all of said
acquisition is situated within the Count of Butte State of California
i.
3, That the law firm of Wilson, Harzfeld, Jones 8c
Morton, and George P, Kading, County-.Counsel, who are attorneys
for said County of Butte, be, and they are hereby directed to
institute and conduct to conclusion an action in eminent domain
for the acquisition of the said easement for drainage facilities
and to take such action as is necessary therein, and said law
firm of Wilson, Harzfeld, Jones & Morton and the County of Butte
shall be paid reasonable fees therefor, said fees to be payable
solely as an incidental expense of Sierra Del Oro Assessment
District.
\ I fro That an Order for Immediate Possession and Use
be obtained in said action, and that a warrant be issued to
the County Cleric Butte County, California, in the amount deter-
mined by the Court to be so deposited, as a condition to the
right of immediate possession.

I hereby certify that the foregoing is a full, true
and correct copy of the resolution duly and regularly passed
and adopted by the Board of Supervisors of the County of Butte,
at a regular meeting thereof held on the 19th day of
January , 196 5 , by the following vote:
AYES, and in favor thereof, Supervisors: Giles, Maxon,
McKillop and Chairman Pryde

EXHIBIT "A"
All that certain real property situate in the County of
Butte, State of California, and more particularly described as follows:
An easement for drainage purposes in the Southwest
quarter of the Southwest quarter of the Southwest quarter of Section
13, Township 23 North Range 3 East, M.D.B. & M., over a strip of land
12.00 feet in width, lying 6.00 feet on either side of a line described
as follows:
Commencing at the Southwest corner of lot 146, as
said lot is shown on the map of "Fir Haven Subdivision," filed in the
office of the Recorder of said Butte County in Map Boo'~c 27, at pages
8, g and 10; thence along the Gdest line of said lot, North 00° 42'
East, 30.00 feet to the North line of Rosewood Drive; thence along
said North line, South 89° 55' 52" Glest, 223.09 feet to the true
point of beginning of the centerline of said easement; thence from
said true point of beginning, North 00° ~2' Esst, 400.00 feet to the
centerline of an existing natural drain.
