BOARD OF SUPERVISORS
l COUNTY OF BUTTE, STATE OF CALIFORNIA
2 RESOLUTION AND ORDER VACATING PUBLIC UTILITY EASEMENT
TN ACCORDANCE WITH SECTION 50443 OF THE GOVERNMENT CODE

`,.¢ ~Tf3EREAS, the owners of the property located in Genny Park
~ Subdivision have requested the vacation and abandonment of the
';s public utility easement hereinafter described; and
7 ~3i3EREAS, the Notice of Intention to Vacate County Easement'
g was duly published and posted, and hearing was duly held on
9 February 9, 1965, at the hour of 11 o'clock A.M., and no person
ilp appearing to object to the same; and
11 W4iEREAS, Pacific Gas and Electric Company and the Ca1if-
'~2 ornia Tdater Service Company have indicated that they are not now,
',1g nor do they in the future, intend to use said public utility
14 easement; and
15 WHEREAS, the Planning Commission of the County of Butte,
'Zg to which said petition was referrr d, has recommended the vacation
~q and abandonment of said easment; and
Ig T~-~EREA.S, said easement was established and dedicated on
lg April 27, 1962, by recordation of that certain subdivision entitle
20 "Genny Park Subdivision" in Book 27 of Maps, at gages 21 and 22,
21 affecting Lots 9 and 10, Records of the County of Butte, and the
22 easement was not used continuously since that date,
23 NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the BOARD OF
24 SUPERVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, as
25 follows:
'26 1, That the hereinafter described public utility easement
27 was not used continuously since the date of its dedication and
28 that said easement is unnecessary for present or prospective
29 public use.
30 2. 'T'hat said public utility easement as hereinafter desc-
31 ribed is hereby abandoned and vacated<
g2 3. That said public utility easement is situated in the

1 County of Butte, State of California, and shown on that map of
2 Genny Park Subdivision as recorded in the office of the County
3 Recorder on April 27, 1962, in Map Book 27, Pages 21 and 22,
4 affecting Lots 9 and 10.
5 4. That this Order of l~bandozurient and Vacation of Public
g Utility Easement is made in accordance with Section 50443 of the
7 Government Code and the Clerk of this Board, in accordance with
g Section 50445 of said Code, shall cause a Certified copy of this
g Order, attested by said Clerk under seal, to be recorded in the
j,0 Office of the Recorder of the County of Butte.
11 PASSED AND ADOPTED at the regular meeting of the Board of
12 Supervisors of t:he County of Butte, State of California, on the
13 9th day of February, 1965, by the following vote:
14 AYES; Supervisors Giles, Maxon, McKillop and Chairman Pryde
