BOARD OF SUPERVISORS
COUNTY OF BUTTE, STATE OF CALIFORNIA
RESOLUTION AND ORDER VACATING PUBLIC UTILITY EASEMENT
IN ACCORDANCE y1ITH SECTION 50443 OF THE GOVERNMENT-CODE
'WHEREAS, the owners of the property located in Highland
Gardens Subdivision have requested the vacation and abandonment
of the public utility easement hereinafter described; and
~r3fiEREAS, the Notice of Intention To Vacate County Easement
was duly published and posted, and hearing was duly held on
February 9, 1965, at the hour of 11 o'clock AoMo, and no person
appearing to object to the same; and
7~iEREAS, Pacific Gas and Electric Company and the Calif-
ornia dater Service Company have indicated that they are not now,
nor do they in the future, intend to use said public utility
easement; and
~3iEREAS, the Planning Commission of the County of Butte,
to which said petition was ref erred, has recommended the vacation
and abandonment of said easement; and
T~:~iEREAS, said easement was established and dedicated on
February 21, 1952, by recordation of that certain subdivision en-
titled "Highland Gardens Subdivision" in Book 19 of Maps, at pages
13 and 14, affecting Lot 1, Records of the County of Butte, and
the easement was not used continuously since that date,
NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the BOARD OF
SUPERVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, as
follows:
1~ That the hereinafter described public utility easement
was not used continuosly since the date of its dedication and
that said easement is unnecessary for present or prospective
public use.
2. That said public utility easement as hereinafter desc-
ribed is :hereby abandoned and vacated.
3. That said public utility easement is situated in the

County of Butte, State of California, described as follows:
That certain twelve foot public utility easement
lying adjacent to and Northerly from the Southerly
line of the following described property:
Lnt 1 as shown on that certain map entitled Highland
Gardens Subdivision filed in the office of the Butte
County Recorder on February 21, 1952, in Book 19 of
Maps at pages l3 and l4~'
EXCEPTING THEREFROM that portion of said easement
lying within a 30 foot strip along Camellia Drive;
ALSO EXCERTING THEREFROM that portion lying within
a 12 foot strip along the Easterly line of said lot.
4. That this Order of .Abandonment and Vacation of Public
Utility Easement is made in accordance with Section 50443 of the
Government Code and the Clerk of this Board, in accordance with
Section 50445 of said Code, shall cause a Certified copy of this
Order, attested by said Clerk under seal, to be recorded in the
office of the Recorder of the County of Butte.
PASSED AND ADOPTED at the regular meeting of the Board of
Supervisors of the County of Butte, State of California, on the
9th day of February, 1965, by the following vote:
AYES: Supervisors Giles, Klaxon, McKillop and Chairman Pryde
