COUNTY OF BUTTE, STATE OF CALIFORNIA
RESOLUTION REGARDING SENATE REAPPORTIONMENT
I~HEREAS, the Butte County Board of Supervisors finds that,
present basis of allocating seats in the Senate of the California
Legislature is fair, just and equitable to all interests within
this State; and
~iEREAS, the people themselves haves in five different
elections affirmed their preference for this, the Federal Plan
of legislative apportionment; and
`ASEREAS, in the words of .justice Harlan, the decision of
the Supreme Court's majority in forcing both houses of all state
legislatures into the straitjacket of "one man~one vote" has the
effect of placing the sovereign states "under the pervasive overw
lordship of the federal judiciary";'and
T~HEREA'S, the implementation of the federal district court
order to reapportion the California Senate would deprive our
citizens of adequate representation and would subject them to the
will of a simple majority of the voters in a few centers of heavy
population; and
~HEREAS9 the Butte County Board of Supervisors does hereby
officially go on record as urging the adoption of an amendment to
the Constitution of the United .States securing .the right of the
states to establish one house of their legislatures on the basis
of factors in addition to population alone subject to the app-
royal of the people
N0~~, THEREFORE, BE IT RESOLVED that the Butte County
Board of Supervisors is hereby instructing the Clerk of said
board to send copies of this resolution to United States Senators
Thomas H. Kuchel and George Murphy, each member of the Congress
from the State of California*.and to the Speaker of the Assembly
of the State of California.
