(~5 -2,~ RESOLUTION OF INTENTION TO ORDER GRANGES IN WORK RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA: That in its opinion the public interest and conven- fence require changes in the work and improvements for SHASTA UNION DRAINAGE ASSESSMENT DISTRICT that are described in the following Resolutions of this Board: Resolution of Intention No. 64-86 passed August 11, 1964 Resolution Ordering Work No. 64-115 passed September 22, 1964 That it is the intention of this Board ~o order the work and improvements for SHASTA UNION DRAINAGE ASSESSMENT DISTRIGT changed, all as follows: I CHANGES IN OUTFACES F AND H (Amended Plan Sheet Nos. 11 and 25) A. Delete open channel work, fencing, and pipelines on Outfalls F and H that was shown on original Plan Sheet Nos. 11 and 25 from Engineer Stations F-59+94 to F-84+85 and from Engineer Stations H-0+00 to H-7+05. B. Construct underground drainage pipelines and necessary appurtenances at locations shown on Amended Plan Sheet Nos. 11 and 25 from Engineer Stations F-59+g4 to F-84+85 and from Engineer Stations H-0+00 tc H-7+05. C. That this Board informs all persons that the County of Butte does not intend to acquire the 45 foot easement described in said Resolution of Intention under the headings Outfall F Item I {a), Outfall F Item I (b), Outfall F Item II {a) and Outfall F Item II (b). D. That this Board informs all persons that the County of Butte does not intend to acquire the 45 foot easement described in said Resolution of Intention as Outfall H and. the two 35 foot easements described in said Resolution of Intention under the heading of "Roads and Easements" in the following words: "An easement 35 feet in width the center line of which is described as beginning at a point on the northeasterly boundary line of Lot 8 of Evar's Tract ii that lies northwesterly along said boundary line a distance of 226.21 feet from the most easterly corner of said Lot 8; thence from said paint of beginning south 52° 30' west a distance of 271.00 feet (Plan Sheet No. 11)", and in the following words. "An easement 35 feet in width the center line of which is described as beginning at a point on the north- easterly boundary line of Lot 16 of said Evan's Tract that lies northwesterly along said line a distance of 312.5 feet more or less from the most easterly corner of said Lot 16; thence from said point of beginning south 52° 30' west a distance of 169 feet along a line that ` is parallel to the southeasterly boundary line of the northwesterly half of said Lot 16 and that is 17.5 feet southeasterly from said southeasterly boundary line (Plan Sheet No. 11)". E. That this Board hereby gives notice to all persons that the County of Butte intends to acquire two underground pipeline easements 20 feet in width in lieu of the 35 foot and 45 foot open channel rights of way described above in paragraph I C and in paragraph ID and that this Board intends to order that the underground drainage pipelines and appurten- ances described above in paragraph I B be constructed in said easements. That the location of the center line of said ease- ments is described as follows: Easement No. 1 Commencing at the most northerly corner of Lot 16 of Evan's Tract the official map of which was filed November 16, 1894 in the office of the Recorder of the County of Butte in Book 3 of Maps at age 67; thence south 37° 30' east along the north- eas erly boundary of said Lot 16 a distance of 340.00 feet to the true point of be inning; thence south 520 30' west a distance of 60.0 feet; thence north 37° 30' west and parallel to and 10.0 feet southwesterly from the northeasterly boundary lines of Lots 15, 10, and 7 of said Evan's Tract a distance of 1640.0 feet to the southeasterly boundary line of Shasta Avenue. Easement No. 2 Commencing at the most easterly corner of Lot 8 of , said Evan's Tract; thence northwesterly along the northeasterly boundary line of said Lot 8 a distance of 218.71 feet to the true point of beginning; thence southwesterly and parallel to the southeasterly boundary line of said Lot 8 a distance of 660.0 feet to the southwesterly boundary line of said Lot 8. 1 F. That this Board hereby gives notice to all persons that the County of Butte intends to acquire a 10 foot easement adjacent to easement numbers 1 and 2 described in paragraph T D above which shall permit the County of Butte, , its Contractor for SHASTA UNION DRAINAGE ASSESSMENT DISTRICT, and its officers, employees and agents to use the surface of the ground covered by said easements for all purposes incidental and necessary for constructing the pipe lines described above in paragraph I B during the time when said pipe lines are being constructed. That the place where said 10 foot easement is located is shown on Amended Plan Sheet Nos. 11 and 25. TT CHANGES IN DESIGN OF DROP INLETS (Amended Plan Sheet No. 24) A. Delete drop inlets shown at Engineer Stations stated below on original Plan Sheet No. 24a 124+06 128+53 "~ 131+53 133+73 147+70 149+66 154+18 159+97 163+47 167+40 171+79 175+79 B. Construct and install one S-7 drop inlet of design shown as section D-D on Amended Plan Sheet No. 24 at Engineer .Station 124+06 and construct and install eleven S-6 drop inlets of design shown as section B-B on Amended Plan Sheet No. 24 at Engineer Stations as follows: 128+53 131+53 133+73 147+70 149+66 154+18 159+97 163+47 167+40 171+79 175+79 III CHANGES TN WORK ALONG HIGHWAY 99E (Amended Plan Sheet No. 20) A. Change location of curb and gutter as shown on ~ Amended Plan Sheet No. 20 from Engineer Stations 142+50 to 144+27. _, B. Delete curb and gutter as shown on Amended Plan Sheet No. 20 from Engineer Stations 140+'72 to 142+50 and delete drop inlet shown on said Amended Plan Sheet No. 20 at Engineer Station 140+86. C. Delete 18" standard concrete pipe from Engineer Stations 145+43 to 14'7+43 and install in place thereof 18" reinforced concrete pipe from Engineer Stations 145+43 to 147+43 as sho~m on Amended Plan Sheet No. 20. D. Delete curb and gutter from Engineer Stations .146+72 to 146+85 and from 147+49 to 147+65 all as shown on Plan Sheet No. 20. IV CHANGES IN WORK ALONG HIGHWAY 99E (Amended Plan Sheet No. 17) A. Delete 24" reinforced concrete pipe from Engineer Stations 128+00 to 128+50 and construct drop inlet at Engineer Station 126+15 and construct 18" reinforced concrete pipe from Engineer Stations 128+00 to 128+50 all in accordance with Amended Plan Sheet No. 17. B. Change elevation of pipe lines from elevations shown on original Plan Sheet No. 17 to elevations shown on Amended Plan Sheet No. 17 from Engineer Stations 124+06 to 129+00 all in accordance with Amended Plan Sheet 17. iii V CHANGES IN OUTFALZS A AND V (Amended Plan Sheet Nos. 15, 25, 30, 31 and 32) A. Delete open channel work and fencing on Outfalls A and V that was shown on original Plan Sheet Nos. 15, 25, 30, 31 and 32 from Engineer Stations A-17+20 to A-42+58 and A from Engineer Stations V-0+00 to V-13+32. B. Construct underground drainage pipe lines and necessary appurtenances at locations on Amended Plan Sheet Nos. 15, 25, 30, 31 and 32 from Engineer Stations A-17+20 to A-42+58 and from Engineer Stations V-0+00 to V-13+32. C. That this Board informs all persons that the County of Butte does not intend to acquire the 45 foot and 35 foot easements described in said Resolution of Intention under the headings Outfall A Ttem II, Outfall V Ttem I (a}, Outfall V Item I b) and. Outfall V Item II. D. That this Board hereby gives notice to all persons that the County of Butte intends to acquire two underground pipe line easements 20 feet in width in lieu of the 45 foot and 30 foot open channel rights of way described above in paragraph V C and that this Board intends to order that the underground drainage pipes and appurtenances described above in paragraph V B be constructed in said easements. That the location of the center line of said pipe line easements is described as follows: Easement No. 1 Commencing at the most southerly corner of Lot 9 of the Hobart Subdivision as filed in the office of the Recorder of the County of Butte in Boob 4 of Maps at page 24; thence northeasterly along the southeasterly boundary of said Lot 9 a distance of 90.0 feet; thence southeasterly, perpendicular to said southeasterly boundary a distance of 10.00 feet to the true point of beginning; thence north- easterly parallel to the southeasterly line of said °'~ Lot 9 a distance of 580.00 feet; thence southeasterly parallel to, and 10.0 feet from, the southwesterly boundaries of Lots 22, 21, 20, 19 and 18 of said Hobart Subdivision a distance of 3290.0 feet to the southeasterly boundary of said Lot 18. Easement No. 2 Beginning at a point on the northeasterly boundary of Godman Avenue that lies northwesterly a distance of 10.0 feet from the most southerly corner of said Lot 9; thence northeasterly parallel to, and 10.0 feet northwesterly from, the southeasterly boundary of said Lot 9 a distance of 110.0 feet; E. That this Board hereby gives notice to all 1 persons that the County of Butte intends to acquire 10 foot easements adjacent to easement numbers 1 and 2 in paragraph V D above which shall permit the County of Butte, its Contractor for SHASTA UNION DRAINAGE ASSESSMENT DISTRICT, and its officers, employees and agents to use the surface of the ground covered by said easements for all purposes incidental and necessary for constructing the pipe lines described above in paragraph V B during the time when said pipe lines are being constructed. That the places where said 10 foot easements are located are shown on Amended Plan Sheet Nos. 15, 25, 30, 31 and 32. That this Board hereby estimates that the rights of way described hereinabove that this Board has announced that it will not acquire will result in a decrease of $30,048.00 in the estimated cost to acquire rights of way for SHASTA UNION DRAINAGE ASSESSMENT DISTRICT and that this Board hereby estimates that the cost to acquire the new rights of way above described for SHASTA UNION DRAINAGE ASSESSMENT DISTRICT is the sum of $10,000.00 and that the said estimated decrease in cost for rights of way and the said estimated increase in cost for rights of way result in a new total estimated cost for rights of way and that said new total estimated cast is the sum of X66,952.00. That this Board hereby estimates that the total cost of all work, improvements and acquisitions for SHASTA UNION DRAINAGE ASSESSMENT DISTRICT will increase from the sum of X573,640.50 to the sum of X627,667.02 on account of the changes in work and in acquisitions above described as follows: Present Estimated Total Cost $395,001.50 For Construction Cost (from Contractors Bid) 91,639.00 For Incidental Expenses 87,000.00 For Casts to Acquire Rights of Way $573,640.50 Total New Estimated Total Cost X460,830.02 For Construction Cost (from Contractor's Bid as changed) 99,885.00 For Incidental Expenses 66,952.00 For Costs to Acquire Rights of Way $627,667.02 Total That it is the intention of this Board to order the County of Butte to acquire each of the easements described above in paragraphs I E, I F, V D and V E and this Board hereby declares that it deems each of said easements to be necessary for constructing, using and operating the public improvements above described and this Board hereby gives notice that it intends to assess the cost of all said easements and all incidental expenses of acquiring the same as a part of the incidental expenses of the above described work and improvements. That the changed work described herein shall be done pursuant to Division 7 of the Streets and Highways Code, the Improvement Act of 1911, and shall be of the sizes, dimensions, materials and in the positions and locations and shall be placed to the grades all as shown and described upon and all in accordance with the amended plans approved by this Board on March ~ 1965, and now on file in the office of the Clerk of this Board and this $oard hereby refers all persons to said plans far all details. That the cost of said changes and the incidental expenses therefor shall be assessed as an additional part of the costs and expenses of the work and improvements described in the two Resolutions the titles of which are set out in the first paragraph of this Resolution and that the lands to be assessed for the costs and expenses of said changes are the same lands that are described in Resolution of Intention No. 64-86 above referred to. That serial bonds to represent unpaid assessments for the cost of the improvement work described in the two Resolutions, the titles of which are set out in said first paragraph of this Resolution as changed in the particulars stated in this Resolution shall be issued in the same form, and for the same time, and in the same manner that are described in Resolution of Intention No. 64-86 above referred to. THAT THIS BOARD HEREBY GIVES NOTICE that it sets March ?;3" , 1965, at the hour of '7c'~o;, o'clock ~.r~"' in the meet- ing room of the Board of Supervisors, of the County of Butte located in the Butte County Courthouse at Oroville, California as the time when and the place where any person having objections to the proposed changes herein described will be heard by this Board and when and where any such person may show cause why said proposed changes should not be ordered, and THAT THIS BOARD HEREBY GIVES NOTICE that any person desiring to protest to said proposed changes may file a written protest in the office of the Clerk of the Board at any time no later than 5:00 o'clock Is?~' on said March X2'1 , 1965. That the Clerk of this Board shall cause this Resolution to be published twice in the Chico Enterprise Record for the period of time prior to said hearing as required by law. That the Clerk of this Board shall mail a copy of this Resolution postage prepaid to each owner of land in said SHASTA UNION DRAINAGE ASSESSMENT DISTRICT and whose name appears on the 1964-65 Assessment Roll for the County of Butte, or whose name is l~.own to the Clerk by any other means, or whose name appears on the last Board roll transmitted to the Auditor of the County of Butte and whose property is shown assessed thereon by the State of California under Section 14 of Article XIII of the Constitution of said State. That the Clerk of this Board shall mail said notice to each such person at least 10 days prior to the date set hereinabove as the date for the public hearing on the matters contained in this Resolution of Intention.
