HomeMy WebLinkAbout65-039SHASTA UNION DRAINAGE ASSESSI~iENT DISTRICT RESOLUTION N0. 5~-39 RESOLUTION OF INTENTION TO ORDER CHANGES IN WORK RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA: That i.n its opinion the public interest and conven- fence require changes in the work and improvements for SHASTA UNION DRAINAGE ASSESSMENT DISTRICT that are described i.n the following Resolutions of this Board: Resolution of Intention No. 64-86 passed August 11, 1964 Resolution Ordering Work No. 64-115 passed September 22, 1964 Resolution No. 65-25, Resolution of Intention to Order Changes in Work passed March 9, 1965 Resolution. No. 65-29, Resolution Order- ing Changes i.n Work passed March 23, 1965 That it is the inte.ntio.n of this Board to order the work and improvements for SHASTA UNION DRAINAGE ASSESSMENT DISTRICT changed, all as follows: THE CHANGES DESCRIBED BELOW TN SUB-PARAGRAPHS A TO F, INCLUSIVE, RELATE SOLELY TO OUTFACE "S" A. Delete open channel work, fencing, riprap and pipelines o.n outfall "S" that was shown on original Plan Sheet 33 from Engineer Station S 6+10 to S 26+25. B. Construct underground drainage pipelines and necessary appurtenances at locations shown o.n Amended Plan Sheet 33 from Engineer's Station S 6+10 to S 6+70. C. Change elevation of open channel invert from elevations shown o.n origi.nal Plan Sheet 33 to elevations shown on Amended Plan Sheet 33 from Engineer's Station S 0+00 to S 6+10, all in accordance with Amended Plan Sheet 33. D. That this Board informs all persons that the County of Butte does not intend to acquire the 45 foot easements on Lots 5, 12 and 13 of the Evan's Tract as described in said Resolution of Intention under the heading Outfall "S". E. That this Board hereby gives notice to all persons that the County of Butte intends to acquire certain underground pipeline easements 20 feet in width i.n lieu of the 45 foot open channel rights-of-way described above in paragraph "D", and that the locations of said 20 foot easements are as follows: The Southwesterly 20 feet of Lots 5, 12 and 13 of the Evans Tract, the official map of which was filed November 16, 1894, in the office of the Recorder of the County of Butte i.n Bcok 3 of Maps at page 67. F. That this Board hereby gives notice to all persons that the County of Butte intends to acquire a 10 foot temporary construction easement northeasterly of and adjacent to the 20 -2- foot easement described in the above paragraph "E" which shall permit the County of Butte, its Contractors, its officers, employees and agents to use the surface of the ground covered by said easements for all purposes incidental and necessary for constructing any future pipeline and .necessary appurten- ances that the County of Butte may install or authorize. That the place where said 10 foot easement is located is shown on amended Plan Sheet 33. (END OF DESCRIPTION OF CHANGES) That this Board hereby estimates that the reductions i.n cost of work arising from the work above described that is to be deleted and that the increases in the cost of work arising from new work above described are as follows: Deletions Reductions `7700 cubic yards channel excavation $ 7,084.00 56 tons rock slope protection 369.60 15 cubic yards concrete grout 360.00 3073 lineal feet property fence 891.17 4 each drag gates 128.00 140 lineal feet 48" re- inforced concrete pipe 3,836.00 Clearing and grubbing 655.00 Increases -3- Additions Reductions Increases 50 linear feet 54" re- inforced concrete pipe at $57.00 per foot $2,850.00 1 each manhole at $1,210.00 each 1,210.00 Total Deletions $13,323.77 Total Increases $4,OG0.00 That this Board hereby estimates that the changes above described will decrease the cost of the work and improve- ments for SHASTA UNION DRAINAGE ASSESSMENT DISTRICT by the sum of $9,2&3.77 and estimates that the engineering and incidental expenses for said SHASTA UNION DRAINAGE ASSESSMENT DISTRICT will increase from the sum of $99,885.00 to the sum of $100,775.00. That this Board hereby estimates that the rights-of- way described hereinabove that this Board has announced that it will .not acquire will result in a decrease of $5,425.00 in the estimated cost to acquire rights-of-way for the SHASTA UNION DRAINAGE ASSESSMENP DISTRICT and that this Board hereby estimates that the cost to acquire the new rights-of-way here- i.nabove described for the SHASTA UNION DRAINAGE ASSESSMENT DISTRICT is the sum of $1,075.00 and that the said estimated decrease i.n cost for rigb.ts-of-way and the said estimated in- crease in cost for rights-of-way result in anew total estimated cost for rights-of-way and the said .new total estimated cost is the sum of $62,602.00. That this Board hereby estimates that the total cost of all work, improvements and. acquisitions for SHASTA UNION DRAINAGE ASSESSMENT DISTRICT will decrease from the sum ~4- of $627,667.02 to the sum of $614,943.25 on account of the changes in work and in acquisitions above described as follows: Present Estimated Total Cost X460,830.02 99,885.00 66,952.00 For construction cost (from (Contractor's Bid and from than es ordered March 23, 1965 For incidental expenses •, For cost to acquire rights- o f -way •~ ,Estimated as at March 23, 1965 X627,667.02 Total New Estimated Total Cost $451,566.25 100,775.00 62,602.00 For construction cost (from Contractor's Bid as changed March 23, 1965, as changed in this Resolution) For incidental expenses •• For cost to acquire rights- o f -tivay •• -Estimated as at date changes described herein are ordered $614,943.25 Total That it is the intention of this Board to order the County of Butte to acquire each of the easements described above in sub-paragraph E and that this Board hereby declares that it deems each of said easements to be necessary for constructing, using and operating the public improvements above described and that this Board hereby gives notice that it i.nte.nds to -5- assess the cost of all said easements and all incidental expenses of acquiring the same as a part of the incidental expenses of the above described work and improvements. That the changed work described herein shall be done pursuant to Division 7 of the Streets and Highways Code, the Improvement Act of 1911, and shall be of the sizes, dimensions, materials and in the positions and locations and shall be placed to the grades all as shown and described upon and all in accordance with the amended plans approved by this Board o.n April 1965, and now on file in the office of the Clerk of this Board and this Board hereby refers all persons to said plans for all details. That the cost of said changes and the incidental expenses therefor shall be assessed as an additional part of the costs and expenses of the work and improvements described in the several Resolutions the titles of which are set out in the first paragraph of this Resolution and that the lands to be assessed for the costs and expenses of said changes are the same lands that are described in Resolution of Lnte.ntio.n No. 64-86 above referred to. That serial bonds to represent unpaid assessments for the cost of the improvement work described in the two Resolutions, the titles of which are set out i.n said first paragraph of this Resolution as changed i.n the particulars stated in this Resolution shall be issued i.n the same form, and for the same time, and in the same manner that are described in Resolution of Lntentio.n No. 64-86 above referred to. _6_ THAT THIS BOARD HEREBY GIVES NOTICE that it sets May 4th 1965, at the hour of 1:3~ o'clock p~M~in the meet- ing room of the Board of Supervisors, of the County of Butte located in the Butte County Courthouse at Oroville, California, as the time when and the place where any person having objections to the proposed changes herein described will be heard by this Board and when and where any such person maY show cause why said proposed changes should .not be ordered, and THAT THIS BOARD HEREBY G1VES NOTICE that a,ny person desiring to protest to said proposed changes may file a written protest in the office of the Clerk of the Board at anytime no later than 1:30 o'clock p,M.o.n said May 4th 1.965. That the Clerk of this Board shall cause this Resolution to be published twice in the Chico Enterprise Record for the period of time prior to said hearing as required by law.
