HomeMy WebLinkAbout65-050wJMI,:JS:amf 5-3-~5 SC RESOLU~rION No . 65-~ A RESOLUTION ORDERING WORK- ~ THE WOODLANDS, UNIT N0. 2 RESOLVED, by the Board of Supervisors of the County of Butte, California, that WHEREAS, said Board did on April 13, 1965, adopt its Resolution of Intention No . 65-35 to order certain .~~.-~=e~r~ std-improvements to be made in said County under and pursuant to the Improvement Act of 1911, and to issue bonds pursuant to said Improvement Act of 1911, reference to which Resolution of Intention is hereby made for a particular description of the ~ d improvements to be made, the boundaries of the assessment district, and the bonds to be issued; W~iEREAS, said Resolution of Intention has been duly publish- ed twice in the Paradise Post, a newspaper of general circulation printed and published in said County, and notices of the passage of said Resolution of Intention headed "Notice of Improvement" and of the time and place of the hearing as fixed by said Resolu- tion of Intention, when and where all persons interested, having any objections to the proposed ~° improvements or F'^ '~ against the district to be assessed for the costs and expenses thereof, or against the grades at which said work shall be done, may appear before said Board and show cause why said proposed improvements should not be carried out in accordance with said Resolution of Intention, were duly posted within the time and I, in the manner provided in said Act, and as directed by said Resolution of Intention, as appears from the affidavits of posting and publication on file in the office of the County Clerk; WHEREAS, at the time. and place fixed for said hearing ~'j O, protests or objections were made or presented to the ~~~ proposed improvements, or to the district to be assessed, or to the grades at which said work was to be done, or to the bonds to be issued to pay the costs and expenses thereof, or to the engineer's estimate of the costs and expenses thereof, and all persons interested desiring to be heard were given an opportunity to be hear and all matters and things pertaining to said proposed as--a~ improvement S; were duly heard and considered by said Board. NOW, THEREFORE, said Board of Supervisors does hereby FINA, DETERMINE and pRDER, as follows: 1. That the plans and specifications for said improvements under said Resolution of Intention, be, and they are hereby, finally adopted and approved as the plans and specifications to which said work and improvements shall be done as called far in said Resolution of Intention. 2. That the engineer's estimate o emized and total e tim~t~ cq is and expenses for said-ac improve- ments under said Resolution of Intention be, and it is finally adopted and approved as the engineer's ~ and detailed estimate of the costs and expenses of said it~.~s~--ate improvements. 3. That the public interest and convenience require, and said Board does hereby order the a-e-e~u-i~~t~r~,~-a~rc~ improvements to be done as described in and in accordance with said Resolution of Intention on file in the office of the County Clerk of said County, reference to whic i reby made for a more particular deserip- tion of said_•e-e~-i.-s-~~+~~d ~.mprovements and also for further particulars, pursuant to the provision he Improvement Act of lgll, such work to be done and ~~ improvements to be made under the direction and subject to the approval of (the Engineer of Work of said County. 2 ll ~}. Said Board .further declares that all public streets I, and highways and other public property within said assessment ~I district, in use in the performance of a public function as such, shall be omitted from the assessment aver to be made to cover the costs and expenses of said ~ ~-'~ improvements. 3 PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, California, on this 11th day of MA'Y , 196 5 , by the following vote: AYES, Supervisors: GILES~ HODISDEN~ MAXON~ McICILLOP~ and C~3ATRMAN PRYDE.
