HomeMy WebLinkAbout65-066l 11 1 2 3 4 5 6 '7 8 9 10 11 '12 '13 14 15 16 17 I 18' 19 20 21 ;22 23 24 25 26 27 28 29 30 37, 32 RESOLUTION N0. 65- 66 BOARD OF SUPERVISORS COUNTY OF BUTTE, STATE OF' CALIFORNIA RESOLUTION AUTHORIZING ACQUISITION OF REAL PROPERTY BY Et~?INENT J~OM,AIN NECESSARY FOR THE CONSTRUCTION OF A COUNTY HIGHWAY KN0~,1N AS COHASSET ROAD, IN THE COUNTY OF BUTTE, STATE OF CALIFORNIAp, BE IT RESOLVED by the BOARD OF SUPERVISORS of the County of Butte, iState of California, that said Board finds and deter mines, and hereby declares, as follows, to wit; 1. That public interest and necessity require the ac- quisition, construction and completion by the County of Butte, of a public improvement, namely, a county highway known as Cohasset Road, in the County of Butte, ;fate of California. 2. That public interest and necessity require the acs quisition for said improvement of the real property, or interest in the real property hereinafter described, together with all improvements situate thereon, and it is hereby found and determines ed that the construction of a county highway is a public use, authorized by law, and that public interest and necessity require the construction of said improvements and the acquisition of said real property hereinafter described, and all improvements situate thereon. 3, Said proposed ptb lic improvement is planned and located in a manner which will be most compatible with the greates public good and the least private injury. 4, That the County Counsel of the County of Butte is hereby authorized and empowered as follows: (a) To acquire, in the name of the County of Butte, a fee simple estate or such necessary interests in and to the hereinafter described real property, or interest in real property, and all improvements thereon by condemnation in accordance with the provisions of the Streets and Highways Code, Code of Civil Procedure and the Constitution of the State of California, relating to eminent domain. (b) To prepare and prosecute for the County of Butte 1 °2 '3 '4 5 6 7 8 9 10, 11 12 13 14 15 '. 16 17 18 19. 20 21 22 23 24 25 28 27 28 29 30 31 32 such proceedings in the proper court having jurisdiction thereof, as are necessary for such acquisition. (c) To make application to said court for an order fixA ing the amount of security in the way of moneys deposited as said court may direct, and for an order permitting the County of Butte to take immediate possession and use of said real property, or interests, or improvements in said real property, a s a right of way for a public highway for public use. (d) To make deposit of such security out of proper funds under the control of the County of Butte, in such amoun~s as fixed and dtermined and in such manner as said court in which condemnation proceedings are pending may direct, and the Auditor is authorized to make said deposit immediately upon the court making said order. 5. The real property, or interest in real property, and/or improvements thereon, which the County of Butte is, by this Resolution, authorized to acquire for said public improve menu in fee simple, is situate in the County of Butte, State of California, and more particularly described as follows: Parcel One• A portion of the west half of Lot 11 as shown on that certain map entitled "Revised Map of the Twelfth Subdivision of the John Bidwell Rancho near Chico, Butte County, California", which map was recorded in the office of the Recorder of the County of Butte, State of California, on December 7, 1906, in Book 6 of Maps, at page 11, and being more particularly described as follows: Beginning at the southwest corner of said Lot 11 on the east right of way line of the Cohasset Highway; th north along said east right of way line 155.43 feet to the northwest corner of that certain parcel of land conveyed by deed to the Church of the Nazarene and recorded in said Recorder's Office September 13, 1962, in Book 1200 Official Records, page 250; thence along the north line of said parcel east 20,00 feet; thence south 155.43 feet to the south line of said Lot 11; thence west along said south line 20.00 feet to the point of beginning. Containing an area of 0..071 acres more or less. -2~- 1 2 4 5 7 8 9 10 11 12 ',13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Parcel Two' A portion of Lot 11, according to that certain map entitled, "Revised Map of the Twelfth Subdivision of the John Bidwell Rancho", filed of record in the Office of the Recorder of the County of Butte, State of California, on ]3ecember 7, 1906, in Book 6 of Maps, at page 11, more particularly described as follows: Commencing at the southwest corner of said Lot 11; thence north along the west line of said Lot 11 and the existing east right of way line of the Cohasset ~ Highway 155.43 feet; thence east 10.00 feet to a point on the north line of that certain parcel of land conveyed to the Church of the l~azarene of Chico and recorded in said Recorder's office September 13, 1962, in Book 1200 Offi cial Records at Page 250, and the true point of beginning of this description; thence north 70.04 feet; thence northeasterly along the arc of a 20,00 foot radius curve, concave to the southeast, through a central angle of 9000', an arc length of 31,42 feet to the south right of way line of Azalea avenue; thence east along said line 10,00 feet to a point of cusp; thence southwesterly along the arc of a 20.00 foot radius curve (radial line to said curve at this point bears north) concave to the southeast, through a central angle of 90~00~, an arc length of 31.42 feet; thence south 70,04 feet to the said north line of the said church parce thence west along said north line, 10000 feet to the true point of beginning. Containing an area of 0.021 acres mor or less. Parcel Three• 1~ portion of the west half of Lot 11 according to that certain map entitled "Revised Map of the Twelfth Sub- division of the John Bidwell Rancho" filed for record in the office of the Recorder of the County of Butte, State of California, on December 7, 1906, in Book 6 of Maps at page 11, more particularly described as follows: Commencing at the southwest corner of said Lot 11 on the east right of way line of the Cohasset Highway as spawn on said subdivision map; thence north along said right of way line 391 31 feet to the southwest corner of that certain parcel of land conveyed to Dominick Squillace and Lorraine Squillace by deed record- ed November 4, 1954, in said Recorder's office in Book 742 Official Records at page 525 and the trse point of beginning of this description; thence east along the south line of said parcel 20.00 feet; thence north 100.29 feet to the south line of that certain parcel of land conveyed by deed to Leslie A. Brown and Edith V, Brown and recorded August 9, 1951 in said Recorder's Office in Book 590 of Official Records page 270; thence east along said south line 20.00 feet to the southwest corner of said parcel and said east right of way line; thence south along said right of way line 100,29 feet to the true point of beginning. Clark and Frieda L. Clark dated November 10, 1962 in Book 1212 of Official Records at page 291; thence north along the west line of said parcel 112,08 feet to th e northeast corner of said parcel; thence west 20.00 feet to the true point of beginning of this description..
