HomeMy WebLinkAbout65-083i ,; RESOLUTION N0, bS~~J BOARD OF SUPERVISORS 1 COUNTY OF BUTTE, STATE OF CALIFORNIA ~2 RESOLUTION AUTHORIZING ACQUISITION OF REAL PROPERTY BY EMINENT DOMAIN NECESSARY FOR THE CONSTRUCTION OF A COUNTY HIGHWAY KNOWN 3 AS HONEY RUN ROAD, IN THE COUNTY OF BUTTE, STATE OF CALIFORNIA 4 BE IT RESOLVED by the BOARD OF SUPERVISORS of the County 5 of Butte, State of California, that said Board finds and deter 6 mines, and hereby declares, as follows, to wit: 7 1. That public interest and necessity require the ac- 8 qusition, construction and completion by the County of Butte, 9 of a public improvement, namely a County Highway known as Honey 10 Run Road, in the County of Butte, State of Californian li 2, That public interest and necessity require the acs 12 quisition for said improvement of the real property, or interest 13 in the real property hereinafter described, together with all 14 improvements situate thereon, and it is hereby found and determines 15 ed that the construction of a County Highway is a public use, I16 authorized by law, and that public interest and necessity require '.17 the construction of said improvements and the acquisition of said 18 real property hereinafter described, and all improvements situate 19 thereon. 20 3, Said proposed public improvement is planned and located 21 in a manner which will be most compatible with the greatest public 22 good and the least private injury. 23 4. That the County Counsel of the County of Butte is 24 hereby authorized and empowered as follows: 25 (a) To acquires in the name of the County of Butte, a 26 fee simple estate or such necessary interests in and to the 27 hereinafter described real property, or interest in real property, 28 and all improvements .thereon by condemnation in accordance with 29 the provisions of the Streets and Highways Code, Code of Civil 30 Procedure and the Constitution of the State of California, 31 relating to eminent domain. 32 (b) To prepare and prosecute for the County of Butte such ~~ • 1 proceedings in the proper court having jurisdiction thereof, as g are necessary for such acquisition. 3 (c) To make application to said court for an order fixing 4 the amount of security in the way of moneys deposited as said 5 court may direct, and for an order permitting the County of g Butte to take immediate possession and use of said real property, q or in•~erests, or improvements in said real property, as a right g of way for a public :highway for public useA- g (d) To make deposit of such security out of proper 10 funds umler the control of the County of Butte, in such amounts 11 as fixed and determined and in such manner as said court in 12 which condemnation proceedings are pending may direct, and the 13 Auditor is authorized to make said deposit immediately upon the 14 court making said order, 15 5, The real property, err interest in real property, and/oz lg improvements thereon, which the County of Butte is, by this 17 resolution, authorized to acquire far said public improvements in lg fee simple, is situate in the County of Butte, State of Califor~ ~g nia, and more particularly described as follows: 20 Being a portion of the south half of the south half of Section 25, T22N, R2E, MDB&M, lying east of the center i21 line of Butte Creek, more particularly described as follows: 22 Beginning at a point on the existing Honey Run Road, 23 said point of beginning being distant N 5349'32+' W, 2659.62 feet from the common corner of Sections 25, .124 36 R2E, 30, 31 R3E, MDB&M, as said corner is shown on that certain map entitled "Record of Survey of a Portion 25 of the East Half of the East ~Ialf of Section 30, T22N, R3E, MDB&M", which map was filed for record in the office '2S of the Recorder of the County of Butte on ,July 16, 1962, in Book 27 of Maps, at page 48; thence from said point of 2p beginning S 6955'27" E, a distance of 30.00 feet; thence- -.
