BOARD OF SUPERVISORS
COUNTY OF BUTTE, STATE OF CALIFORNIA
RESOLUTION CONCERNING STATE OF CALIFORNIA STATE
"CATER RIGHTS BO#~RD ORDER ON THE MIDDLE FORK PROJECT
TaHEREA'S, State of California State~Aater Rights Board, in
the matter of applications 13681, 13682, 14919, 15551, and
15552 held by Richvale Irrigation District on behalf of joint
water districtsy has adopted its order and decision; and
'AHEREAS certain conditions have been imposed, namely
Condition 27 of Decision D~1224 providing that at the conclusion
of the Middle Fork Project payout period the permitee shall share
net prower revenues on an equal basis with the County of Plumas;
and
'~7HEREA'8, the following conditions prevail, to wit:
1, The Fish and Game Department has now asked that the
remaining 50% of such net revenues be paid to it,
2, The Middle Fork Project is a necessary and desirable
development and provides valuable water, recreation and power
benefits, and the Board of Supervisors of Butte County reaffirms
its support of the project.
3, The County of Plumas will be the principal beneficiary o
the recreation benefits of the project by way of having a reservoi
constructed at Clio that will be comparable to a natural lake with
insignificant drawdown in addition to a lake at Nelson Point and
improved stream flows in that portion of the Middle Fork of the
Feather River in Plumas County,
4. In contrast, no comparable reservoirs will be eo.nstruc
in Butte County, and any damage to the fishery will occur almost
exclusively in Butte County where the stream flow is diminished
rather than augmented during the first 50 years of project
operation; and

Wf-IEREA'S, in acuity, the County of Butte is more entitled to
a share in the net power revenues after the project payout period
than is Plumas County; and
'AHEREAS, no justification whatsoever can be seen for paying
any portion of such revenues to the Fish and Game Department; and
"WHEREAS, this board recognizes that the farmers and landowners
in the four districts seeking to build the project will be required
to risk many hundreds of thousands of dollars before it is possible

NOSE, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISOR,
OF THE COUNTY OF BUTTE, that Condition 27 of the States G7ater
Rights Board Decision Dh1224 be amended to provide for an
impartial commission to determine an equitable manner for the
distribution of the net power revenues, including therein the
,consideration of the County of Butte for all ar a portion of said
~ revenueso
~! BE IT FURTHER RESOLVED that a copy of this resolution be
I~',certified and forwarded to the State'xTater Rights Boa rd for its
,consideration at its meeting on November 16, 19C5o
PASSED AND ADOPTED by the Board of supervisors of the County
of Butte, State of California, this 16th day of November ,
1965, by the following vote:
AYES: SUPERVISORS GILES, HOWSDEN, MAKON, McKILLOP and
CHAIRMAN PRYDE
