HomeMy WebLinkAbout65-133SHASTA UNION DRAINAGE ASSESSMENT DISTRICT RESOZ~UT ION NO . ~~ : / 3 `~ ORDERING CHANGES IN ASSESSMENT AND CONFIRMING PROCEEDINGS AND ASSESSMENT WHEREAS, on November 19, 1965 CLAYTON CASTLEBERRI~ then the Acting County Surveyor - Director of Public Works of the County of Butte, State of California, filed with the Clerk of this Board, an Assessment together with a Diagram and Engi- neer's Certificate attached thereto to represent the costs and expenses (includi.ng incidental expe.nses), for the work of con- structing drainage improvements consisting of channels, pipes, ditches, and appurtenances within and adjacent to the boundaries of Shasta Union Drainage Assessment District in said County of Butte, which work is more particularl~r described in the following resolutions of this Board: Resolution of Intention 64-86 adopted August 11, 1964 Resolution Ordering Work No. 64-115 adopted September 22, 1964 Resolution 65-25, Resolution of Intention of Order Changes in Work adopted March 9, 1965 -1- Resolution 65-29, Resolution Ordering Changes in Work, adopted March 23, 1965 Resolution 65-39, Resolution of Intention to Order Changes in Work, adopted April 20, 1965 Resolution No. 65-48, Resolution Ordering Changes in Work, adopted May 4, 1965 Resolution No. 65-93, Resolution of Tntention to Order Changes in Work, adopted September 14, 1965 Resolution 65-98, Resolution Ordering Changes in Work, adopted September 28, 1965 and WHEREAS, this Board has held hearings respecting said Assessment on December 6, 1965 and on this date December 21, 1965, and WHEREAS, written appeals were filed in respect to said Assessment, and WI~REAS, Clayton Castleberry now the County Surveyor - Director of Public Works has recommended changes in the Assess- meat on account of said written appeals, and WHEREAS, this Board desires to follow the recommenda- tions of the County Surveyor - Director of Public Works, and WHEREAS, all persons have been heard who appeared and presented any facts or protests to this Board in respect to said Assessment and in respect to the amounts assessed on the several parcels of property in said assessment district, and WHEREAS, from hearing said persons this Board has determined that it is necessary and desirable to make certain changes in said Assessment and Diagram and this Board hereinafter sets forth in detail all said changes, and -2_ WHEREAS, this Board is satisfied that with the changes that this Board herewith orders that the County Surve~or- Director of Public Works has correctly assessed the costs and expenses of the work and improvements above described on each parcel of land i.n the District to be benefited therefrom in accordance with the benefit that each parcel of land receives therefrom, and this Board is satisfied that said Assessment is correct as changed and that this Board should confirm all the proceedings in respect to said work and improvements. BOW THEREFORE RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUAITY OF BUTTE: 1. That this Board hereby orders the County Sur- veYor - Director of Public Works to change the Assessment pre- sented to this Board for the wank for Shasta Union Drainage Assessment District that is described in the recitals to .this Resolution in the following particulars. -3- a. Changes in Property Descriptions and Changes In The_Dia~ram (1) He shall delete from the Assessment the descriptions for Assessment Parcel Nos. 4-170-76 and 4-170-74 and he shall combine the description for said assessment parcels into one description which is shown below and he shall insert that description in the Assessment where it shall become a new Assessment Parcel No. 4-170-74. The description for new Assessment Parcel No. 4-170-74 shall be as follows: A11 that certain real property situate in the County of Butte, State of California, described as follows: Beginning at a point on the Southeasterly line of the Reed Park Subdivision Unit No. 1, South 53045.! West, 200.00 feet from the most Easterly corner of Lot 2 of said Unit No. l; thence South 36°15' East, 150 feet; thence South 53 45' West, 134.34 feet; thence South 36°15' East.,.:-240.00 feet; thence North 53°45'. (5a) HE. shall change the diagram. to show the deletion and splitting ordered in 5 above. -11- (6) He shall delete Assessment Parcel No. 4-500-18 and he shall divide the land which was Assessment Parcel No. 4-500-18 into two .new Assessment Parcels the descriptions of which and the numbers of which are as follows: 4-500-26 911 that certain real property situate. in the County of Butte, State of California described as follows: Commencing at the most Westerly corner of Lot 6 of the Esmeralda Tract; thence North 52°39' East, 330 feet; thence South 37°21' East, 150 feet to the True Point of Beginning; thence South 37°21', East 80 feet; the.nee South 52°39' West, 140 feet; thence North 37°21' West, 80 feet; thence North 52039' East, 140 feet to the True Point of Beginning. 4-500-27 911 that certain real property situate in the County of Butte, State of California, described as follows: Beginning at a point on the Northwesterly line of Lot 6 of the Esmeralda Tract, North 52039' East, 294.89 feet from the most- Westerly corner thereof; thence North 52°39' East, 35.11 feet; thence South 37021' East, 150 feet; thence South 52°39' West, 140 feet; thence North 02°23' 06" West, 183.04 feet to the point of beginning. (6a) He shall change the diagram to show the deletion and splitting ordered in 6 above. -12- b. Changes in Amounts Assessed on Assessment Parcels He shall delete from the Assessment the amount of money that is now assessed on each Assessment Parcel in the Assessment and he shall insert in the Assessment (revised as set out in paragraph "a" above) the new total amount of money that is shown after each Assessment Parcel Number in Exhibit A attached hereto which Exhibit A this Board hereby orders shall be a part of this Resolution. 2. That all protests filed against the ASSESSMENT for Shasta Union Drainage Assessment District and all appeals of every kind relating thereto except those appeals for which this Board ordered the changes set out above, and all other protests and appeals relating to the proceedings for the work and improvements for Shasta Union Drainage Assessment District be and they hereby are overruled. 3. That all proceedings for the work and improve- merits for Shasta Union Drainage Assessment District described in the Resolutions that this Board referred to in the recital paragraphs of this resolution be and they hereby are confirmed. 4. That the ASSESSMENT for the work and improve- meats for Shasta Union Drainage Assessment District and the DIAGRAM and the ENGINEER'S CERTIFICATE attached thereto be and they hereby are confirmed in all respects as filed except -15- as this Board has changed them herein. 5. That the Chairman of this Board and the County Surveyor -Director of Public Works be and they are hereby authorized and directed to sign the WARRANT attached to said ASSESSMENT as provided by laver.
