AN ORDINANCE ZONING A PORTION OF THE
it COUNTY OF BUTTE, STATE OF CALIFORNIA,
PURSUANT TO ORDINANCE NOS. x.75 and 522

'g The Board of Supervisors of the County of Butte, State of
California, under and pursuant to Ordinance No. 4.'75 of said
`~} County, being the Zoning Enabling Ordinance of said County and
as amended by Ordinance No. 522, DO ORDAIN AS FOLLONrS:

Section 1. The hereinafter described areas situate in the
6 County of Butte, State of California, shall be zoned as "R--1"
(Single Family Residential) District and as "R-3Ee (Multiple
;7 Dwellings) District, anal subject to all of the restricted uses
applica'~le to said districts, said areas so zoned being located
g in the unincorporated area of the Community of Chico, particular-
ly described as follows:
,g A. "R-1" (Single Family Dwellings) District, Bel-Aire
;10 Subdivision, Units 1, 2 and 3, as recorded in the
office of the Butte County Recorder in Map Book
1"1 Nos. 21, 22 and 23.
'' 1:2 1. Uses Permitted:
,~~ a. Single family dwellings, not including tests
and trailers.

';~s c. The following subject to the securing of a Use
Permit in each case: Golf courses and °country
17 clubs, public and quasi -public uses, including
churches, fire houses, hospitals, parks and

B. T'R-3'r (Multiple Family Dwellinggs) District,
20 Hobart Subdivision, Lots 15, 1b and 1'7, as recorded in
the office of the Butte County Recorder in Map Book

22 1. Uses permitted:
23 a. Multiple family dwellings, 2--family dwellings
and single family dwellings, not including tents
24 or trailers.
'25 b. Accessory buildings per'inent to the permitted
uses.

c. The following subject to the securing of a Use
2q Permit in each case: Golf courses and country
clubs, public and quasi--public uses, including "
28 churches, fire houses, hospitals, parks and
playgrounds, schools and public utility build-

~1 ,. Section 2. Minimum building. area required:

Eight-thousand, one hundred twenty-five ($,125)

!8 Section 3. In addition to the uses permitted under
Section 2 hereof, but only upon land fronting upon Lassen avenue
9 within the area hereinabove zoned, and not to exceed seven
hundred fifty feet (750) feet in depth from the centerline of
i l0 said Lassen Avenue, the following uses are permitted:
;1.1 A. General commercial uses, including the following:
Retail stores and shops_of a light commercial
~2 character and conducted within a. building, in-
eluding appliance stores, banks, .barber shops,
13 beauty parlors, book stores, cleaners and
launderettes, dress shops, drug stores, food
'j4 stores, furniture stores, millinery shops, pro-
fessional offices, restaurants, refreshment
75 stands, studios, tailor shops and other uses
which are of a similar character to those
16 enumerated and which will not be detrimental or
obnoxious to the neighborhood in which. they are
j7 located .
j;g a. Each such commercial use shall be subject
to the approval by the Planning Commission of plans
I9 for the same, which plans shall include off--street
parking areas adequate to the use; and no such eom-
~4 mercial use shall be undertaken or established
until plans therefor are submitted to and approved
21 by the Planning Commission.
22 B. The following uses, subject to the securing of a
use permit in each case from the Planning Commission;
~3 All uses in which a Use Permit is required in TtR-lrr~
'PR-2'T and 'TR-3'T Districts: Auto courts and trailer
'i 24 Courts, public and quasi--public uses, animal
hospitals, auto sales, dancing`academies and halls,
2g open air retail sales, theaters, pet shops, used
car sales, used or secondhand goods and other uses
2g of a similar character .
27 a. Each applicant for a Use Permit hereunder
shall submit plans for `the Use to the Planning
` 2g Commission at the time of or within a reasonable
time after the filing of application for the D[se
2g Permit, which plans shall include off-street parking
areas adequate to the proposed Use.

Section 1r.. A11 uses of land within the above described
31 districts not specifically authorized and permitted are
prohibited.
32 Section 5. Penalties for any violation of the zoning hereby
imposed within the District shall be as provided in the Zoning
Enabling Ordinance. In compliance with the provisions of the
Zoning Enabling Ordinance, this Ordinance shall from and after
its effective date become a supplement to and part of the Zoning
Enabling Ordinance.

Section 6. This Ordinance shall be and it is hereby de-
clared to be in full force and effect from and after thirty (3O)
days after the date of its passage, and before the expi~x~ation
of fifteen (15) days after its passage this ordinance shall be
published once Urit~ the names of the members voting for and
against, in the ~'~ L-C-~ ~~^-`~~-'~-~"'-`~~~; ~ a newspaper published zn
the County of Butte, State of California.
PASSED AND ADOPfiEDr by the Board of Supervisors of the
County of Butte, State of California, this 19th day of QcTOber ,
1959, by the following vote:
