HomeMy WebLinkAbout66-007_ WJML: J'HH: rd- x./13/66 12c RESOLUTION N0. 6b- 7 A RESOLUTION OF INTENTION.TO ACQUIRE AND CONSTRUCT IMPROVEMENTS SIERRA DEL ORO, UNIT N0. 2 AND ADJACENT AREA RESOLVED, by the Board of Supervisors of the County of Butte, California, that in its opinion the public interest and convenience require, and that it is the intention of said Baard to order the acquisitions and improvements more particularly described as follows: 1.{a) The improving of Holmwood Drive, Glenwood Drive, Wood Drive and Imperial Way for their entire lengths and widths, as shown on the Map of Sierra Del Oro Estates Unit PTo. 2, re- corded in the office of the County Recorder, County of Butte in Book 3~ of Maps at Pages 27 to 29, inclusive, by clearing, grubbing and grading, and the construction therein of paving consisting of oil penetration and double -rock seal coat, on aggregate base within Sierra Del Oro Estates Unit No, 2, to- gether with drainage facilities, and all other necessary appurtenances for the above described improvements. (b) ,The improvement of the north one-half of Rosewood Drive as shown on the recorded map of Sierra Del. Oro Estates Unit No. 1 recorded in the office of the County Recorder of the County of Butte, in Book 30 of Maps at Pages ~E7 to ~+9, inclusive, from Maga.lia. Drive to a point approximately ,700 feet t•?esterly therefrom by constructing therein a drainage pipe line, together with all necessary appurtenant facilities, (c) The acquisition of a five f'o^t z•ride easement contiguous and southerly of the north line of Lot 3,, Lot 4 and Lot ~3, a.nd a five foot wide easement contiguous and r_ortherly of the south line of Lot 54 and Lot 6~., all of said Serra Del Oro Estates Unit No. 2, and the construction therein of a drainage pipe line together with ali necessary appurtenant facilities. (d) The acquisition of a. seven and one-half foot wide easement contiguous a.nd southerly of the south line of Lot 129 and the southerly end of Holmwood Drive in said Sierra Del Oro Estates Unit No. 2 and the construction therein of a drainage ditch, together with all necessary appurtenant facilities. (e) The construction of all work and improvements and the acquisition of all lands, easements a.nd rights of way auxiliary to any of the above and necessary to complete the same 2. Whenever any public way is herein referred to as running between two public ways, or from or to a.ny public way, the intersections of the public ways referred to are included to the extent that work is shown on the plans filed herein. All the work shall be of the forms, sizes, dimensions, depths, in the locatians and to the grades as more particularly shown on the plans, profiles and specifications thexefor approved by the Board of Supervisors of said County. 3. There is excepted, however, from the work any and all thereof which has already been done or laid to official line and grade as heretofore adopted a.nd established in said plans, profiles and specifications. 4. Reference is hereby made to the plans and specifica- tions on file in the, office of the County Clerk of said County, and the same are incorporated herein as if fully set forth. 5, Said Board does hereby a-dopt and establish as the official grades for said work the grades and elevations shown upon said plans, profiles and specifications. A11 such grades and elevations a.re to be in feet and decimals of feet with re- ference to the official base and datum plane of the U. S. Coast Geodetic Suxvey, as described in said plans and specifications- &. Notice is hereby given of the fact that in many cases said work and improvement will bring the finished work to a grade different from that formerly existing, and that to said extent said grades are hereby changed and that said woxk will be done to said changed grades.. 7, Said Board further declares that all public streets and highways within said assessment district in use in the performance of a public function as such, shall be omitted from the assessment hereafter to be made to cover the costs and ex- penses of said acquisitions and improvements. 8. Said contemplated acquisitions and improvements, in the opinion of this Board, are of more than local or ordinary public benefit a.nd said Board does hereby make the costs and expenses thereof chargeable upon an assessment district, the exterior boundaries of which district are the coterminous exterior boundaries of the composite and consolidated area shown on the map thereof on file in the office of the County 2 Clerk which indicates by a boundary line the extent of the territory included in the proposed district and which shall govern for all details as to the extent of the assessment district, to which reference is hereby made for a more particu- lar description thereof. 9. Notice is hereby given that serial bonds to represent unpaid assessments and bear interest a.t the rate of six per cent (6~) per annum will be issued hereunder in the manner. provided by Division 7 of the Streets and Highways Code, the Improvement Act of 1911, and the last installment of such bonds shall mature fourteen (1~) years from the second day of January next succeeding the next September lst following their date. Said bonds shall be made payable to bearer and provide a premium of five per cent (5/} of the unmatured principal thereof on call. 10. All of said work, improvements and acquisitions shall be done pursuant to the provisions of the Improvement Act of 1911, as arnended. 11. Reference is hereby made to proceedings had under the Special Assessment Investigation, Limitation and Majority Protest Act of 1931, on file in the office of the County Clerk. 12. The PARADI';SE P05T , a newspaper of general circulation printed and circulated in said County, is hexeby designated as the newspaper in which this Resolution of Intention shall be published, and the County Clerk is hereby directed to cause this Resolution of Intention to be published by two insertions in the manner and form provided by law. 13. The County Surveyor shall cause to be conspicuously posted along the line of said contemplated work and improvements, at not more than 300 feet in distance apart, and along all the open streets and avenues within said district, and in front of all property liable to be assessed, at not more than 300 feet in distance apart, but not less than 3 in all on each street in 3 said district, notices of the passage of this Resolution of Intention, in the manner and form required by the Improvement Act of 1911 and amendments thereto. l~. Notice is hereby given that on Tuesday, the lst day of MARCH 1966, at the hour of 11.00 otclock A.M., in the Chambers of this Board, Court House, Oroville, California, any and all persons having any objections to the proposed work or improvements or acquisitions herein described or to the pro- posed grades at which said work or improvements or acquisitions are to be done and made, or having any objections to the pro- posed district to be assessed therefor, or the boundaries or extent thereof, may appear before said Board and show cause why said proposed work or improvements should not be carried out in accordance with this Resolution of Intention. 16.
