2 RESOLUTION IN RE APPROVAL AMENDMENT N0. 1 TG DWR
AGREEMENT N0. 353760
4 BE IT RESOLVED By THE BOARD OF SUPERVISORS OF THE COUNTY
~ OF BUTTE, STATE OF CALIFORNIA, AS FOLLOWS:
g 1. That Amendment No. 1, DWR Agreement No. 353760 is
7: hereby approved and the Chairman of this board is authorized to
8 execute and sign said amendment on behalf of the County of Butte.
9 2. T1Lat County, by its approval of this Amendment No. 1
LO' to DWR Agreement No. 353760, does not concede that County is not
11 e=titled to reimbursement, and a further amendment to tine ma;>imum
12 payable to County under said DWR Agreement No. 353760, by reason
13 of change orders heretoa`ore or hereafter made to County's contract
14 No. 27561-65-1, and which change orders are not included in this
15; aincndrnent, and County specifically reserves any and all rights
16 that County may have against Department of Water Resources and
17 the State of California to recover reimbursement on such. change
lg orders not included in said Amendment- No. 1.
yg 3. That the Clerk of this board shall certify and attach a
2p copy or this resolution to the original and all copies of Amendmen
2I No. 1 to DWR Agreement No. 353760.
22 PASSED AND ADOPTED by the Board of Supervisors of the
23' County of Butte, State of California, at the regular meeting
24 thereof on the 8th day of March, 166, by the following vote:
