HomeMy WebLinkAbout66-044WJMLoJSo~t 2/23/66 lOC RESOLUTION N0. 66-~~ A RESOLUTION ORDERING WORK SIERRA DEL ORO, UNIT N0. 2 AND ADJACENT' AREA RESOLVED, by the Board of Supervisors of the County of Butte, California, that WHEREAS, said Board did on January 18, 196b, adapt its Resolution of Intention No. 66-7 to order certain improvements to be made in said County under and pursuant to the Improvement Act of 1911, and to issue bonds pursuant to said Improvement Act of 1911, reference to which Resolution of Intention is hereby made for a particular description of the acquisitions and im- provements to be made,-the boundaries of the assessment district, and the bonds to be issued; WHEREAS, said Resolution of Intention has been duly pub- lisped twice in the Paradise Post, a newspaper of general circu- lation printed and published in said County, and notices of the passage of said Resolution of Intention headed "Notice of Im- provement" and of the time and place of the hearing as fixed by said Resolution of Intention, when and where all persons inter- ested, having any objections to the proposed improvements or against the district to be assessed for the costs and expenses thereof, or against the grades at which said work shall be done, may appear before said Board and show cause why said proposed improvements should not be carried out in accordance with said Resolution of Intention, were duly posted within the time and in ` the manner provided in said Act, and as directed by said Resolu- tion of Intention, as appears from the affidavits of posting and publication on file in the office of the County Clerk; WHEREAS, at the time and place fixed for said hearing no protests or objections were made or presented to the proposed improvements, or to the district to be assessed, or to the grades at which said work was to be done, or to the bonds to be issued to pay the costs and expenses thereof, or to the engineer's estimate of the costs and expenses thereof, and all persons in- terested desiring to be heard were given an opportunity to be heard, and all matters and things pertaining to said proposed acquisitions and improvements were duly heard and considered by said Board. NOW, THEREFORE, said Board of Supervisors does hereby FIND, DETERMINE and ORDER, as follows; 1. That the plans and specifications for said improvements under said Resolution of Intention be, and they are hereby, fin- ally adopted and approved as the plans and specifications to which said work and improvements shall be done as called for in said Resolution of Intention. 2. That the engineer's estimate of the itemized and total estimated costs and expenses for said improvements, under said Resolution of Intention be, and it is finally adopted and approved as the engineer's total and detailed estimate of the costs and expenses of said improvements. ~ 3. That the public interest and convenience require, and said Board does hereby order the improvements to be done as des- cribed in and in accordance with said Resolution of Intention on file in the office of the County Clerk of said County, reference to which is hereby made for a more particular description of said improvements and also for further particulars, pursuant to the provisions of the Improvement Act of lgll, such work to be done and improvements to be made under the direction and subject to the approval of the Engineer of Work of said County. 4. Said contemplated work and improvements, in the opinion of said Board, are of mare than local ar ordinary public benefit, -2- _l ~ i and said Board does make the expense of said work and improvements chargeable upon a district, which. district said Board declares to be the district benefited by said work and improvements and to be assessed to pay the costs and expenses thereof, which said assess- meat district and the exterior boundaries thereof are as described in said Resolution of Intention on file in the office of the County Clerk. 5. Said Board further declares that all public streets and highways and other public property within said assessment district, in use in the performance of a public function as such, shall be omitted from the assessment hereafter to be made to cover the cost and expenses of said improvements.
