HomeMy WebLinkAbout66-049BUTTE CREEK ESTATES ASSESSMENT DISTRICT RESOLUTION NO. ~ 6 - ~~ APPROVING PETITION TO ACQUIRE PUBLIC IMPROVEMENT WORK, and TO CONSTRUCT PUBLIC IMPROVEMENT WORK, AND ORDERING PROCEEDINGS TAKEN UNDER THE MUNICIPAL IMPROVF~NT ACT OF 1913 WHEREAS, on ~ ~'G /~, 1966, a certain corporation filed with this Board its petition requesting that this Board commence proceedings under the Municipal Improvement Act of 1913 and thereby: (1) To acquire certain public improvement work described in said petition, and (2) To do and construct certain public improvement work described in said petition, and (3) To form an assessment district to be known as BUTTE CREEK ESTATES ASSESSMENfi DISTRICT, and to assess the cost and. expenses of acc~.ring said work and constructing said work on lands in said District, and WHEREAS, said corporation declares in its said petition that it is the owner of more than sixty per cent (60~ of the area of the real property subject to assessment -1- for the cost to acquire said improvement work and for the cost to construct said improvement work and declares in its petition that it waives the provisiens of the Special Assess- ment Investigation, Limitation and Majority Protest Act of 1931, and WHEREAS, said corporation requested this Board in said petition to order serial bonds to be issued in accord- ance with the provisions of the Improvement Act of 1911 to represent any unpaid assessments for acquiring and constructing said public improvement work, and that said bonds contain any provision or term in them that is permissable under said Improvement Act of 1911, and WHEREAS, said district of lands includes all the lots in the subdivision known as Butte Creek Estates Subdivision Unit No. One, and WHEREAS, an ovmer of land in said assessment district has filed statements with said petition and said statements show the County Surveyor-Director of Public Workfs esti~ed costs of said improvements that will be assessed against the lands in said assessment district and show said owners' opinion that said estimated cost of said improvements wi11 not exceed `75% of the estimated fair market value of the lands in said assessment district after the pro posed public improvements described in said petition shall have been constructed. NOVV THEREFORE, RESOLVED BY THE BOARD OF.SUPERVTSORS 0~` THE COUNTY OF' BUT'~E: That this Board finds and determines respecting _ 2.. the petition filed with the Clerk of this Board on~~~=-1 196G, that the owner of more than 60~ in area of the real property described therein has signed said petition and has waived all the provisions of Division 4 of the Streets and Highways Code {The Special Assessment, Investigation, Limitation and Majority Protest Act of 1931) and all investigations, proceedings and reports provided for therein. That this Board hereby grants the mane BUTTE CREEK ESTATES ASSESS~NT DISTRICT to the area described in s aid peti t ion. That this Board hereby grants said petition and hereby determines to commence proceedings under the provi~ sions of the Municipal Improvement Act of 1913 for acquiring and constructing the public improvement work described in said petition and for assessing all the cost of acquiring and constructing said public improvement work and the incidental expenses thereof on the lands in said Butte Creek Estates Assessment District. That tn.is Board hereby finds and determines that the estimated cost of the public improvements that will be assessed on the lands in the Assessment District known as Butte Creek Estates Assessment District will not exceed 75% of the fair market value of the lands in said Assessment District after the public improvements described in said petition shall have been constructed and acquired. That this Board hereby determines to issue improvement bonds under the provisions of the Improvement -3- Act of 3.911 to represent unpaid assessments and hereby determines that said bonds shall contain any provision or term in them that is permissable under said Improvement Act of 1911.
