HomeMy WebLinkAbout66-052BUTTE CREEK ESTATES ASSESSMENT DISTRICT RESOLUTION N0. 6` -SZ RESOLUTION OF INTENTION RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA: That in the opinion of this Board the public interest and convenience require and it is the intention of this Board, acting pursuant to the Municipal Improvement Act of 1913, to acquire by purchase for the County of Butte certain public improvement work now done and installed and constructed on public streets and easements located in the County of Butte: The streets and easements in the County of Butte where said public improvement work has been done are as follows: On Estates Drive from its intersection with California State Highway 99E to a point 33 feet north of the easterly projection of the south line of Lot 38 as shown on the official plat of Butte Creek Estates Subdivision Unit No. One recorded in the office of the Recorder of Butte County in Book 34 of Maps at pages 34 through 37, inclusive. -1- The pu'olic improvement work hereinabove referred to is more particularly described as follows: 1. 125,820 sq. ft. asphalt paving 2. 8,320 cu. yds. roadway excavation 3. 6,990 lin. ft, curb and gutter 4. 40 lin. ft. 12" R.C. Pipe 5. 10 lin: ft. 15" R.C. Pipe 6. 116 lin. ft. C~~.' Arch Culvert 7. 1 S-6 Drop Inlet 8. 1 S-7 Drop Ir~l.et 9. 4 gutter drains 10. 1 valley gutter 11. 1 concrete headwall 12. 4 concrete headwalls 13. 185 tin. ft. 12" R.C. Pipe 14. 42 lin, ft. 24" R.C. Pipe 15. 3 S-6 drop ir~.ets, and remove existing curb and gutter 16. ~ 3 S-7 drop inlets, and remove existing curb and gutter -2- That in the opinion of this Board the public interest and convenience require and it is the intention of this Board acting pursuant to the Municipal Improvement Act of 1913 to do and perform certain public improvement work on the public streets and easements located in the County of Butte as follows: That Fairway Drive, Fairview Circle, Riverview Circle, Greenview Circle within the subdivision Butte Creek Estates Subdivision Unit No. One as shown on the official plat thereof recorded in the office of the Recorder of Butte County in Book 34 of Maps at pages 34 through 37, inclusive, and That Estates Drive from a point 33 feet North of the Easterly projection of the Southerly line of Lot 38 of said sub- division to its intersection with Chico- Oraville Highway be improved by construct- ing thereon grading, pavement with asphaltic concrete, curbs, gutters, and drainage facilities and all necessary appurtenances. That the approach of Chico-Oroville Highway and Estates Drive be improved by constructing pavement with asphaltic concrete, curbs, gutters and all necessary appurtenances. That the following described easements be improved by constructing drainage facilities: From a point on the Easterly boundary line between Lots 80 and 81 of said subdivision Easterly approximately 370 feet to the bank of Robbers Gulch. From a point on the Westerly boundary of the line between Lots 85 and 86 of said subdivision, Westerly 110 feet to the bank of the Durham. Mutual Irrigation District Ditch. From a point on the Easterly boundary line between Lots 60 and 61 of said subdivision., Easterly 290 feet to the bank of the Durham 1Vhztual Irrigation District Ditch. -3- From the most Southerly corner of Lot 58 of said subdivision, southeasterly 330 feet to the bank of the Durham Mutual Irrigation District Ditch. That all necessary appurtenances for the above described improvements be cots tructed. That all of said improven.ent work shall be done and acquired pursuant to Division 12 of the Streets and Highways Gode of the State of California, the Municipal Improvement Act of 1913, as amended, and shall be of the sizes, dimensions, materials, and in the positions and locations and to the grades as shown and described upon and all in accordance with the plans and specifications for Butte Creek Estates Assessment District to be prepared pursuant to Section 10,204 of the Streets and Highways Code of the State of California. That in the opinion of this Board the public interest will not be served by allowing the property owners to take the contract to perform the improvement work herein described, and such property czvners shall not be permitted to enter into a written contract to do said work. That it is the opinion of this Board that said work and improvements and acquisitions are of more than local and ordinary public benefit and that this Board: __ hereby orders that the costs and expenses of said work and improvements and acquisitions shall be charged upon a district and that this Board hereby declares that said district is the district to be benefited by said work and improvements -4- and that said district shall be assessed to pay the costs and expenses of said work and improvements and acquisitions. That the exterior boundaries of said district and the extent of the territory included therein are shown upon the map of said Butte Creek Estates Assessment District adopted and approved by this Board on / 196fi. That said map is now on file in the office of the Clerk of this Board and this Board hereby refers to said map and to-the Resolution approving said map for a pa~icular description of the boundaries of said district and the extent of the territory included in said district and that this Board hereby declares that the area of all public highways, streets, and roads included in said district are excepted from said district. THAT THIS BOARD HEREBY GIVER NOTICE that Serial Bonds, made payable to bearer, shall be issued pursuant to Part 5, Division '7 of the Streets and Highways Code to represent unpaid assessments of X50.00 or mare, and that said bonds will bear interest at the rate of six per cent (6%) per annum and that the last principal installment due on said bonds shall mature fourteen (14) years from the 2nd day of January next succes~ing the lst day of September following their date, and that the redemption provisions of said bonds shall provide a premium of five per cent (5%) of unmatured principal if redeemed before maturity. Tbat this Board hereby finds and determines that if after the above public improvement work bas .been constructed and acquired, the assessment herein proposed results in a surplus remaining in the improvement fund established for -5- the proceedings herein proposed, then said surplus shall be used in such amounts as the Board of Supervisors may determine for the purposes and in the manner provided for in Section 10,427 of said Streets and Highways Code. That this Board hereby refers the proposed improve- ment work and acquisitions herein described to Walter B. Grimes, R.C.E. who is a competent person this Board has employed for the purpose of referring the same to him and hereby directs him to make and $le with tb.e Clerk of this Board the Report in writing specified in Section 10,204 of the Streets and Highways Code and hereby direots him to include in said Report all the matters provided for in said. Section 10,204.
