HomeMy WebLinkAbout66-076__ _ __ . -.~6~`~~ BUTTE CREEK ESTATES ASSESSMENT DISTRICT €, ~.~ RESOLUTION N0. r 7~ APPROVTNG REPORT, CONFIRMING ASSESSMENT ORDERING ASSESSMENT RECORDED ORDERING IMPROVEMENTS TO BE CONSTRUCTED ORDERING IMPROVEMENTS TO BE ACQUIRED AND DESTGNATING TREASURER TO COLLECT AND TO RECEIVE MONEY WHEREAS, on April 19, 1966, this Board adopted its Resolution No. 66-62 Resolution of Intention, and de- clared therein its intention to acquire certain public improvement work under the provisions of the Municipal Improvement Act of 1913 that is now installed and con- structed on a designated public street in the Counter of Butte and to construct certain public improvement work on designated public streets and easements in the County of Butte, and ~ WHEREAS, on April 19, 1966, in said Resolution No. 66-52 this Board appointed WALTER B. GRIMES, R.C.E., to mare a report to this Board in the form, stile and man- ner required by said Act, and WHEREAS, on April 19, 1966, said WALTER B. GRIMES, R.C.E., did make a report and did file the same with the -1- same with the Clerk of this Board, and WHEREAS, on April 19, 1966, this Board duly con- sidered said Report and then adopted Resolution No. 66-54 entitled in part "Approving Report of WALTER B. GRIMES, R.C.E., Prepared for Proposed Butte Creek Estates Assessment District" and thereby preliminarily approved said report, and o.n that date set this dap, Map 24, 1966, as the date for a public hearing on all matters contained in said Resolution of Inten- tion and in said Report and on the matter of the County of Butte acquiring the public improvement work described in said Resolution and in said Report and on the matter of the County of Butte constructing the public improvement work described i.n said Resolution and in said Report and on the matter of the extent of the proposed Assessment District described in. said Report anal on the matter of the proposed assessment set forth in said Report, and WHEREAS, on April 19, 1966, this Board ordered the Clerk of this Board to give notice of said hearing by posting, publishing and mailing all as required under said act, and WHEREAS, on this date the Clerk of this Board has shown by his affidavit filed with ,this Board that he caused notices of the said hearing to be posted, published and mailed all in the time and form required by said Act, and WHEREAS, this dap is the day regularly set for hearing any person who desires to object to any matters con- tained in said Resolution of Intention or to the County of Butte acquiring the public improvement work described in, said Report or to the County of Butte constructing the pub- -2- tic improvement work described in said Report or for hearing any person who desires to object to the extent of the pro- posed Assessment District described in said Report or to any matter respecting the Assessment contained in said Report, and ~flHERE9.S, no person has filed any protest respecting said Resolution of Intention or to said Report or to the extent of the proposed Assessment District described in said Report or to the Assessment contained therein or to the County of Butte acquiring the improvements described in said Report, or to the County of Butte constructing the improvements described in said Report, NOW THEREFORE RESOLVED BY TIDE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE, CALIFORNIA 1. That this Board finds that each of the recitals of this Resolution is true. 2. That this Board finds and determines that the Engineer's estimate of the cost of constructing and doing the new work described in said Report which is not installed in place was the sum of $151,298.40 based upon the Engineer's estimated quantities and the Engineer's estimated unit prices. That this Board finds and determines that the clerk has advertised for bids. on said new work and that the Engineer has advised this Board that the cost of the .new work based upon the Engineer's estimated quantities and the successful. contractor's unit prices is the sum of $~ 124,923.82 That this Board hereby finds and determines that because the successful contractor's bid for the new work described in the Report is lower than the Engineer's estimate -3- for said work that the Report and Assessment should be re- vised in the following particulars: a. Revise the Engineer's estimate in the re- port to show the contractor's bid price for each item of work-and to show the new Total Estimated Construction Cost" derived from such bid prices. b. Revise the items of Incidental Expenses in the report that are computed as percentages of the bid price. c. Revise the page in the Report to show the total amount of money to be assessed which results from the bid price. d. Revise the assessment pages to show the con- tractor's unit prices and to show the charges in the incidental expenses and in the total amount to be assessed which result from said prices. e. Revise the amount of money assessed on each subdivision of land described in the Assess- ment to show the benefits from the new work to each such subdivision that result from the contractor's bid prices for the new work being lower than. the Engineer's estimate of prices for said new work. That this Board finds and determines that WAITER B. GRIMES, R.C.E., has revised the Report and Assessment in each of the particulars above stated all to the satisfaction of this Board and hereby declares that its action on such Re- port and Assessment is that the Report and Assessment as so revised should be confirmed with no other changes or revisions except those stated above in this Resolution and this Board therefore hereby approves the Report that was filed with this Board by WAITER B. GRIMES, R.C.E., as so revised and hereby confirms the assessment contained in said Report as so revised. 3. 'That this Board hereby orders the Clerk of this Board to transmit to the County Surveyor of the County of -4- _~ Butte, the Assessment and Diagram contained in the Report hereinafter referred to and hereby directs said County Sur- veyor to record said Assessment and Diagram in his office and to give notice. of the filing thereof by publishing and mailing as provided by law, a`nd to record the notice required by law i.n the office of the Recorder of the County of Butte showing that said Assessment and Diagram have been recorded in his office. 4. That this Board hereby orders that the County of Butte shall acquire by purchase for the County of Butte the improvements to the Street in and adjacent to BUTTE CREEK ESTATES ASSESSMENT DISTRICT that is described in the Report of WALTER B. GRIMES, R.C.E. that is hereinafter referred to, and hereby orders that the purchase price for said improve- ments shall be a sum ofmoney not in excess of the sum of $53,395.59 which sum is the estimated cost of all the im- provements shown in said Report that Gounty of Butte will acquire by purchase and that he shall pay said sum solely from the funds arising from collections on the Assessment for BUTTE CREEK ESTATES 9SSESSMENT DISTRICT and from the sale of bonds issued to represent unpaid assessments i.n said assess- ment district. 5. That this Board hereby orders that the public improvement work shall be constructed and done that this Board declared its intention to construct and do in Resolu- tion No. 66-52, Resolution of Intention, adopted April 19, 19fi6, and this Board hereby determines that said work is also the work that WALTER B. GRIMES, R.C.E., described in his -5- Report to this Board dated April 19, 1966, as work to be constructed and done. 6. That this Board hereby' orders that the Treasurer of the County of Butte shall collect and receive the money from property owners on account of said Assessment. 7. That the Report hereinabove referred to is that certain report approved April 19, 1966, by this Board in its Resolution No. 66-54 and that bears the identifying legend as follows: "Report Respecting Proposed Butte Creek Estates Assessment District Municipal Improvement Act of 1913".
