C-186.3 ON WEST LINDO AVENUE AND AUTHORIZING CHAIRMAN TO SIGN BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows: (1) That said Board approves the Application for Grade Crossing No. C-186.3 on West Lindo Avenue and that the Chairman of said Board is hereby authorized to execute the same on behalf of the County of Butte; (2) That the Clerk of the said Board is hereby authorized to certify this Resolution and forward the required copies to tihe Public Utilities Commission of the State of California. APPLICATION T0: The Honorable Public Utilities Commission of .the State of California The application of the County of .Butte respectfully shows: 1; That-the applicant is a political subdivision of the State of California; . 2. That the post office address of the applicant is: Department of Public Works, 7 County Center Drive, Oroville, California. 3. That the applicant hereby requests authorization to relocate a public street crossing of the railroad right of way of .the-Southern Pacific Company. 4. That the County of Butte and the Southern Pacific Company are agreed upon the allocation of costs of improvement and installation of protective devices at said crossing: Such allocation should be " made in accordance with the Letter received from Southern Pacific- Company attached hereto as Exhibit "B",.and incorporated herein. Also.a~t~ched to and incorporated herein as Exhibit "C" is our letter ; of concv.rrence to the Southern Pacific Company. Maintenance costs of signals at said crossing are to be apportioned. ' in accordance with and .pursuant to the provisions of Section 1202.2" ,Public Utilities Code and the County`s libaility;.therefore, shall be limited to such funds as are set aside for allocation to the Commission pursuant to Section 1231.1 Public Utilities Code. 5. That;' (a) The legal description of the proposed crossing is as follows:. Commencing at the most northerl;~ common corner of Lots 91 and • 92 as shown on that certain map oi`. "The Second Subdivision of the John Bidwell Rancho", filed far record in Book 5 of Maps, at page 27, Butte County Official Records; thence N 60°49'00" W along the northeasterly line of said Lot 92,1.0..00 feet to the true point of beginning; thence continuing al.on, said northeasterly line N 60°49'00" W,~60.OC feet; thence N 9°11'00" E 100.00 feet to a point on the northeasterly right of ~.ay line of the Southern. Pacific Railroad; thence S 60°49'00" E along said right of way line, 60,00 feet; thence 5 29°11`00"td 100 00 feet to the true point of , beginning. ' (b) The crossing number of the ex:is ing crossing which is to be relocated i& C-186.4. The new crossing should bear the number C-186.3., -z- (c} The existing crossing is being relocated to remove a hazardous; intersection-with State Highway 32. (d) The .crossing will be at grade: Crade separation is not prac- tical due fo disproportionate cost to the areas benefited. (e) In accord with Exhibit "B" attached, it is recommended that automatic gates be provided at this crossing. (f) Attaohed hereto and marked Ez:hi:it "A" ~e a map and~plan which shows accuzately the location of ~:he proposed crossing relocation, a vicinity map of the area adjacer_t o the proposed crossing, and a profile showing the ;rode of the proposed highway across the rails at the proposed crossing, all in ~cc rdance with and to the scale requixed in subdivis'_ons (f), (g) any'.
