HomeMy WebLinkAbout66-093~'r ORIGINAL COUNTY OF BUTTE BUTTE COUNTY SERVICE AREA N0. 26 RESOLUTION N0. 66-93 RESOLUTION CALLING A SPECIAL BOND ELECTION FOR THE PURPOSE OF SUBMITTING TO QUALIFIED ELECTORS- OF BUTTE COUNTY SERVICE AREA N0. 26 A MEASURE FOR INCURRING A BONDED INDEBTEDNESS OF SAID COUNTY SERVICE AREA FOR THE ACQUISITION, CONSTRUCTION AND COMPLETION OF A SEWER SYSTEM FOR SAID COUNTY SERVICE AREA; DECLARING THE NECESSITY FOR INCUR- RING SUCH INDEBTEDNESS; STATING THE PURPOSE THEREOF; DECLARING THAT THE WHOLE OF THE COUNTY SERVICE AREA WILL BE BENEFITED THEREBY; STATING THE AMOUNT OF THE INDEBTEDNESS TO BE INCURRED, THE MAXIMUM TERM THE BONDS TO BE ISSUED SHALL RUN BEFORE MATURITY, AND THE RATE OF INTEREST TO BE PAID THEREON; FIXING THE DATE OF SAID ELECTION AND THE MANNER OF HOLDING THE SAME; ESTABLISHING ONE ELECTION PRECINCT AND POLLING PLACE FOR SAID ELECTION AND APPOINTING OFFICERS TO CONDUCT SAID ELECTION; AND PROVIDING FOR NOTICE THEREOF WHEREAS, the Board of Supervisors of the County of Butte has duly passed and adopted a resolution declar- inP; the necessity fvr Butte County Service Area No. 26 to incur a bonded .indebtedness, stating the purpose for which the proposed bonded indebtedness is proposed to be incurred 1 and the amount thereof, and fixing a time and place of hearing thereon; and WHEREAS, notice of such hearing has been duly given and said hearing has been duly held in the manner and for the time prescribed by law; and WHEREAS, this Board of Supervisors, by resolu- tion duly passed and adopted, has determined that. the whole of the county service area would be benefited by the accomplishment of the purpose therein stated and by the issuance of bonds in the amount therein set forth; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE, AS FOLLOWS: 1. The foregoing recitals are, and each of them is, true and correct and this Board so finds and determines. 2. This Board deems it necessary to incur a bonded indebtedness in the amount of $900,000 for the pur- pose hereinafter set forth,; and this Board so finds, deter- mines and declares. 3. The purpose for which said proposed debt is to be incurred is to provide within the county service area sewage service, requiring the construction and installation of facilities for the collection, treatment and disposal of sewage of Butte County Service Area No. 26 and its inhabit- ants, comprising main ~Llines, pipes, pumps, machinery, lands, easements, rights of way, and other works, property or structures, useful ar necessary for the collection, treatment or disposal of sewage of said Butte County Service Area No. 26 and its inhabitants. 2 4. The whole of the county service area will be benefited by the accomplishment of said purpose and by the incurring of said bonded indebtedness, all in accordance with the determination of this Board as earlier expressed. 5. The principal amount of the debt to be in- curred for said purpose is $900,000. 6. The maximum term the bonds to be issued shall run before maturity shall be forty (40) years after the date of said bonds. 7. The rate of interest to be paid on said bonds shall be seven per cent (7%) per annum, payable annually for the first year and semiannually thereafter; provided that said bonds may be offered for sale at any lower rate of interest, but not in excess of seven per cent (7~) per annum, payable as aforesaid. 8. The measure to be submitted to the electors of the county service area shall be as follows: MEASURE: Shall Butte County Service Area No. 26 incur a bonded indebtedness in the sum of $900,000 for the purpose of the acquisition, construc- tion and completion of facilities for the collection, treatment and disposal of sew- age of Butte County Service Area No. 26 ~u,~,,~.GL and its inhabitants, comprising main ~ lines, pipes, pumps, machinery, lands, easements, rights of way, and other works, property or structures, useful or necessary for the collection, treatment or disposal of sewage of said Butte County Service Area No. 26 and its inhabitants? 3 9. A special bond election is hereby called and ordered to be held in the county service area on Tuesday, August 23, 1966, at which election there shall be submitted to the qualified electors of the county service area the measure herein above set forth. This Board does hereby sub- mit to the qualified electors of the county service area at said special bond election the said measure and desig- nates and refers thereto in the ballot hereinafter pre- scribed for use at said election. 1Q. The polls at the polling place hereinafter mentioned shall be opened at seven o`clock A.M. and shall be kept open continuously thereafter until seven o'clock P.M, on the day of said election, when said polls shall be closed (except as provided in Section 14u36 of the Elec- tions Code of the State of California}, and the election officers shall thereupon proceed to canvass the ballots cast thereat. 11. Said special bond election shall be held and conducted and the votes thereat canvassed, and the re- turns thereof made, and the result thereof ascertained and determined as herein provided. 2n all particulars not pre- scribed in this resolution said election shall be held in accordance with the general election laws of the State of California so far as the same shall be applicable. The returns of said election shall be made out and signed by the election officers and shall be by them deposited with the County Clerk of the County of Butte, together with the ballots cast at said election, and this Board shall meet and canvass said returns on its first regular meeting after said election, to wit: Tuesday, August 30, 1966, at the hour of _.M. Upon such canvass, if it shall b.e 4 found that said measure carried, then bonds of the county service area in the aggregate principal amount so approved shall be issued and sold by the Board, and if it shall be found that said measure failed to carry, the result thereof shall be entered accordingly. 12. For the conduct of said special bond elec- tion the county service area shall constitute one (1) special bond election precinct, the boundaries of which shall be coterminous with the boundaries of the county service area. A11 marks except the cross (X) are forbidden. All distinguishing marks or erasures are , forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the Inspector of Election and obtain another. On absent voter ballots mark a cross (X) with pen or pencil. The County Clerk of the County of Butte is hereby directed to cause notice of said special bond elec- tion hereby called to be given by causing a notice of said election containing this resolution to be published once a week for two (2) successive weeks pursuant to California Government Code Section 606b, in the oroville Mereurv , a newspaper of general circulation circulating within the county service area. 16. This resolution shall take effect immediately. At said meeting said resolution was introduced by Supervisor Giles and read in full, and was thereupon, upon motion of Supervisor Maxon , seconded by Supervisor Howsdea , adopted by the following vote: AYES: Supervisors Howsden, Maxon, Pryde and Chairman Giles NOES : None ABSENT: Supervisor McKillap T have carefully compared the same with the original minutes of said meeting on file and of record in my office and said resolution is a full, true and correct copy of the original resolution adopted at said meeting and entered in said minutes. The original resolution has not been amended, modified or rescinded since the date of its adoption and the same is now in full force and effect.
