HomeMy WebLinkAbout66-165RESOLUTION N0. 66-~ BOARD OF SUPERVISORS COUNTY OF BUTTE, STATE OF CALIFORNIA 1 RESOLUTION OF INTENTION TO ANNEX TERRITORY TO COUNTY 2 'SERVICE AREA N0. 24 AND TO DESIGNATE A CHANGE OF TAX ZONE, FROM ZONE 2 to ZONE 1 {Government Code, Section 3 25210.80, et seq., and Section 25210.5) 4 ~i~7HEREAS, the Board of Supervisors of the County of Butte, 5 has determined that services of the type now being provided within 6 County Service Area No. 24 should be provided in another hereinafte 7 described portion of the unincorporated area of Butte County; and g WHEREAS, it appears that an area,pr~sently;:inn Tax Zone 2 9 of said County Service Area Nc. 24 is receiving a benefit which 10 would be comparable,to the Zone 1 of said service area, the herein» 11 after described area of said presa*~ Zone Area 2 should be changed i2 to Tax Area Zone 1, 13 NOW, THEREFORE, BE IT RESOLVED BY the Board of Supervisors 14 of the County of Butte as follows: 15 1. That the territory described in Exhibit "A", which is 16 attached hereto and made a part hereof by reference, is the 17 territory proposed to be annexed to County Service Area No. 24. lg That the boundaries of the territory to be annexed to County 19 Service Area No. 24 are more particularly described in Exhibit 99Aff 2p attached hereto and made a part hereof. 21 2. That the type of extended county services proposed to 22 be provided in this area is the operation, maintenance, repair and 23 upkeep of drainage and flood facilities located within the 24 boundaries of the area described herein as Exhibit 1'A". 2g 3. That said described area to be annexed shall be 26 designated as Zone 2, within the meaning of the Government Code 27 Section 25210.8, and that a tax rate to the extent of the benefit 28 of said Zone 2 derived from the services provided to the property 29 within said zone shall be set by the Board of .Supervisors of the 30 County of Butte. 31 4. That the area hereinafter described on Exhibit "B", 32 which exhibit is incorporated herein by reference and made a part 10 11 12 13' 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 hereof as though fully set forth, is presently established as done 2, and that the county services which are performed and by which said zone and area benefits is more properly included within done 1, and that this Board of Supervisas intends to establish the property described in Exhibit °4B" as a Tax Area done 1, it being the proper zone of benefit which said area receives from the said services. 5. That on the ~ day of ~;~~~ Py,b.~ , 196, at the hour of 11 A.M., in the Supervisors Room of the Gourthouse, of the County of Butte,, located in the City of Oroville at Bird and Huntoon Street, for the hearing on the question of annexation of the property described herein on .Exhibit °°A", and the hearing on the question of change of zone for the property described in Exh'zbit °AB", all to the within County Service .urea 24, will be held. 6. The Clerk of the Board of Supervisors shall give the Notice of Hearing as prescribed by Iaw. Field in Book 1137 of Official Butte County Records at page 158; thence southwesterly along said parcel a distance of 455.0 feet to a point which is 205.0 feet northeasterly from the centerline of Godman Avenue; thence northwesterly parallel to and 205.0 feet from the centerline of Godman Avenue, a distance of 198.0 feet to the northwesterly line of said parcel; thence northeasterly along the northwesterly line of said parcel a distance of 18.57 feet to a point which is 223.57 feet from the centerline of Godman Avenue; thence northwesterly in a straight line parallel to and 223.57 feet from the centerline of Godman Avenue to a point which is 195.5 feet from the centerline of Eaton Road and which is the most northerly corner of that certain parcel of land heretofore recorded from H. L. and V. L, Saylor to E. M. Learned in Book 1255 of Official Butte County Records at page 561; thence southwesterly at right angles to the centerline of Eaton Road, a distance of 625.0 feet to a point; thence northwesterly in a straight line parallel to and 401.43 feet from the centerline of Godman Avenue to a point on the centerline of Eaton Road; thence easterly along the centerline of Eaton Road to the point of beginning.
