HomeMy WebLinkAbout66-1801 2~ 3 4 5 6 7 8 9 10 I1 12 13 14 15 16 17 18 19 20 21 22 23 2~ 25 26 27 28 29 30 31 32 RE50}LUTION NO.. 66 - / ~ D BOARD OF SUPERVT'SORS COUNTY OF BUTTE, STATE OF CALIFORNIA RESOLUTION .ANNEXING TERRITORY' TO COUNTY SIlZVICE AREA N0. 24 (Government Code Section 25210,80 et seq} WHEREAS, heretofore on the 22nd day of November, 1966, the Board of Supervisors of the County of Butte, State of California, adopted and passed a Resolution of Notice of Intention To Annex Territory To County Service Area No. 24; and WHEREAS, said resolution fixed the 20th day of Aecember, 1966, at 11:00 A.M. of said day in the Board of 'Supervisors' Room, Courthouse, City of Oroville, 'State of California, as the time and place for the public hearing for the annexation of said territory. and change of zone; and WHEREAS, said Board at said time and place proceeded to hear arguments, both. for and against the annexation of said territory and change of zone; and WHEREAS, no written protests against the annexation or change of zone of said territory were filed, NOW, TI~EREFORE, BE TT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows: 1. That said board hereby finds and determines the proceedings herein were conducted pursuant to Government Code Section 25210.80, et seq., and that publication and notice were given pursuant thereto, and that said board finds and determines that the extent to which the services described are extended are county services. 2. That said board hereby determines to annex territory to said County Service Area Noo 24o The property is hereinafter described as Parcel 1. 3. That the boundaries of said territory to be annexed to . said Service Area Noo 24 are hereby finally determined and 1 established and fully described as follows: A11 that certain real property situate, lying and being in the County of Butte, 'State of California, and more particularly described as follows: PARCEL l: 1 Beginning at the intersection of the centerline of Eaton Road and the centerline of Burnap Avenue 2 located in Section 10, T22N, RlE, MDB&M; thence southeasterly along the centerline of Burnap Avenue 3 to the northeasterly corner of Lot 34 of the Hobart Subdivision as shown on the map of said subdivision, 4 as recorded in the office of the Butte County Recorder in Map Book 4, Page 22, said corner being a point on 6 the centerline of Burnap Avenue; thence southwesterly along the southeasterly lines of Dots 34 and 23 of said 6 Hobart Subdivision to the most southerly corner of Lot 23, being a point on the centerline of Norseman. Avenue; 7 thence northwesterly along the centerline of Norseman Avenue to the most easterly corner of Lot 22 of Hobart 8 Subdivision aforementioned, said corner being a point on the centerline of Norseman Avenue; thence southwesterly 9 along the southeasterly line of said Lot 22 to the most southerly corner of said Lot 22; thence northwesterly 10 along the southwesterly line of said Lot 22, a distance of 264.0 feet to the most easterly corner of that certain 11 parcel of land heretofore recorded from G. E. & D.L. Bigger to C.W. & S.L. Field in Book 1137 of Official Butte County 12 Records at page 158; thence southwesterly along said parcel a distance of 455.0 feet to a point which is 205.0 feet 13 northeasterly from the centerline of Godman Avenue; thence northwesterly parallel to and 205,0 feet from the center- 14 line of Godman Avenue, a distance of 19$.0 feet to the northwesterly line of said parcel; thence northeasterly 15 along the northwesterly line of said parcel a distance of 18.57 feet to a point which is 223.57 feet from the 16 centerline of Godman Avenue; thence northwesterly in a straight line parallel to and 223.57 feet from the center 17 line of Godman Avenue to a point which is 19505 feet from the centerline of Eaton Road an d which is the most north- 18 erly corner of that certain parcel of land heretofore recorded from H.L. and V.L. Taylor to E.M. Learned in Book 19 1255 of Official Butte County Records at page 561; thence southwesterly at right angles to the centerline of Eaton 20 Road, a distance of b25.0 feet to a point; thence north- westerly in a straight line parallel to and 401.43 feet. 21 from the centerline of Godman Avenue to a point on the centerline of Eaton Road; thence easterly along the center- 22 line of Eaton Road to the point of beginning. 23 PARCEL 2: Beginning at the intersection of the easterly line of the 24 west half of Section 31, T22N, RIE, MDBc~M, with the center- line of Big Chico Creek; thence westerly along the center- 25 line of Big Chico Creels. to the Mt. Diablo Meridian; thence northerly along said Mt. Diablo Meridian to its intersectior 26 with the centerline of Grape Way; thence easterly along the centerline of Grape Way to the point of intersection with 27 the centerline of Dairy Road; thence nort~ierly along the centerline of Dairy Road a distance of 1075.7 feet to the 28 point of intersection with the westerly prolongation of the northerly line of that certain parcel of land hereto- 29 fore recorded from L. & E. Bentz to L.W. and R.N. Robertson in Book 1257 of Butte County Official Records at page 32; 30 thence easterly along the northerly line of said parcel a distance of 640.0 feet to the northeast corner of said 31 parcel; thence southerly along the east line of said parcel a distance of 109.50 feet to a point; thence east to a 32 point in the center of dandy Gulch; thence northeasterly 2. a 4 1 2 3 4 5 6 7 8 9 10 11 12 13 i4 15 16 17 is 19 20 21 22 23 24 2B 26 27 28 29 30 37. 32 along centerline of 'Sandy Gulch to the point of intersection with the northerly prolongation of the east line of Lot 50 of the Bidwell Seventh Subdivision as shown on the map of said subdivision, as recorded in the office of the Butte County Re- corder in Map Book 5, page 29; thence southerly along the east line of hot 50 and Lot 63 of Bidwell Seventh Subdivision aforementioned to a point in the centerline of Big Chico Creek; thence westerly along said centerline to the point of beginning. 4o That the type of extended services to be provided within said territory to be annexed is for the purpose of operating, main- taining, repairing and the upkeep of drainage and flood facilities located within the boundaries of the area. 5. That said described area to be annexed shall be design aced as Zone 2 (Parcel 1), within the meaning of Government Code Section 25210.8, and that a tax rate to the extent of benefit toy said zone derive from services provided to the property within said zone shall be set and levied upon all taxable property within said zone. 6o That the area herein described as Parcel 2, is presently established as Zone 2, and that the county services which are performed and by which said zone and area benefits is more properly included within Zone 1, and this board hereby establishes the property described as Parcel 2 as a Tax Area Zone 1, it being the proper zone of benefit which said area receives from the said services.
