HomeMy WebLinkAbout67-038 1 2 4 8 7 S 9 10 31 12 13 14 15 18 17 18 ~9 20 21 a2 23 24 26 zs z7 28 29 30 31 32 RESOLUTION N0. 67--38 MAINTENANCE OF TRAk'FIC SIGNALS ESPLANADE AND EAST AVENUE WHEREAS, the County of Butte has traffic signals installed at the intersection of esplanade and East Avenue and; WHEREAS, the County does not have adequate personnel. or equipment for the maintenance of such traffic signals; NOW, THEREFORE, BE TT RESOLVID that the State of California, Division of Highways, be requested to maintain said signal system at an estimated cost of X75 for the 1966-67 fiscal year. BE IT FURTHER RESOLVED that the following "save Harmless" provision is approved by the Board in connection with such maintenance. "It is expressly understood and agreed by the County that the State of California and its officers and its employees shall not be answerable or accountable in any manner for injuries to or the death of persons or for any damage to property resulting from the operation of or the failure to maintain the traffic signals. The County agrees to idemnify and save harmless the State of California and its officers and employees from all suits, actions or claims of any character. brought as a consequence of the operation of or the failure to maintain the traffic signals." BE IT FURTHER RESOLVID that the County will d®posit sufficient funds not to exceed $75 with the Division of Highways for the maintenance of said signals during the 1966-67 fiscal year.
