HomeMy WebLinkAbout67-046.-- RESOLUTION N0, 67-G6 RESOLUTION OF PRELTA9IA'ARX DETERA4INATION TO UR~DERTAKE SPECIAL ASSESSP~IENT }'ROCEEDINGS FOR TFIE CONSTRUCTION OF IMPROVEI.4ENTS, MANGROVE AVENUE ASSESSti[ENT DISTRICT, COUNTY OF BUTTE, STATE OF CALIFORA~IA BE IT RESOLVED by the ?3oard of Supervisors of the County of Butte, State of California, as follows: 1. Petitions for the construction of improvements by special assessment proceedings of the property within the boundaries.of the map designated "Proposed Boundaries, }~?angrove Avenue Assessment Dis- trict, County of Butte, State of California," which said map is on file in the office of the County Clc~r}: of the County of Butte, are incorporated herein by this reference as though fully set forth herein. Z, It is hereby ordered and determined that the terms and condi- tions of the said petitions heretofore incorporated herein be, and they are hereby, accepted, and that the construction of improvements and the acquisition of rights of ~:~ay shall be made in accordance i•~itl~ the terms of said petition, and that the assessment district proceed- ings shall be instituted and carried through in accordance with the terms of said petitions. 3. It is hereby found, determined and ordered that R'ALTER B. GF.IMES shall be Engineer of i4'ork in accordance with the terms and conditions of letter from said IVALTER B. GRIMES, which said letter is on file with the proceedings. It is further ordered that STURGIS, DEN-DUCK, DOUGLASS is ANDERSON shall be Special Bond Counsel to prepare all proceedings in accordance with the terms and conditions of letter from said STURGIS, DEN-DUCK, DOUGLASS ~ ANDERSON, which said letter is on file with the proceedings. 4. That the public convenience and interest will be served by the taking of special assessment proceedings for the. improvements and acquisitions set forth in said petitions hereinabove referred to. Said work is of more than ordinaryruhlic benefit and the cost and expenses thereof should be borne by a district benefited by said N improvements and acquisitions. Said district shall be knotan and designated as "Mangrove Avenue Assessment District, County of Butte, State of California." 5. The district tvhich shall bear the cost and expenses of said improvements and acquisitions, including all incidental expenses, and t.hich is to be assessed to pay fox the cost thereof, is that district shoran on a map which is on file in the office of the County Clerk of the County of Butte and which is entitled "Proposed Boundaries, Mangrove Avenue Assessment District, County of Butte, State of California." Said district is also specifically described by metes and bounds on Exhibit A attached to this resolution, which said Exhibit A is, 'by this reference, incorporated herein and made a part hereof. 6. That all of said proceedings shall be undertaken without expense to the County of Butte, except that there tti~i11 be contribu- tion tott~ard the cost of the taork by the County of Butte, the exact amount to be later determined. 7.
