HomeMy WebLinkAbout67-049RESOLUTION A'0. 67=49 RESOLUTION OF INTENTION TO ADOPT RESOLUTION OF INTENTION AND REQUESTING JURISDICTION OF THE CITY OF CHICO FOR b1AKING THE IMPROVF:A1ENTS AND ACQUISI- TIONS, MANGROVE AVENUE ASSESSA]ENT DISTRICT, COUNTY OF lili'1 TE. , STATE OF CALIFORNIA BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, that the County of Butte proposes to adopt a Resolution of Intention, a copy of which is annexed hereto marked "Exhibit A" and, by this reference, incorporated herein as though fully set forth herein; and BE IT FURTfIER RE50LVED t;y said Board of Supervisors as follows: 1. A portion of the property proposed to be assessed lies within the area of the City of Chico. 2. The area of the City of Chico which lies tivithin the pro- posed assessment district will, in the opinion of the Board of Supervi- sors of the County of Butte, be benefited by the improvements and ac- quisitions referred to in the iroposed Resolution of Intention annexed hereto. 3. The proposed Resolution of Intention annexed hereto and marked "Exhibit A" is hereby adopted as the proposed Resolution of In- tention for the improvements and acquisitions hereinabove referred to. 4. The consent of the City of Chico, through its City Council, is hereby requested to the formation of the district described in said proposed Resolution of Intention, to the improvements and ac- quisitions therein described, and to the assumption of jurisdiction by this Board of Supervisors for all purposes in connection with the formation of said assessment district, the improvements and acquisitions, the assessment of property, and the Counts- Clerk of- said Butte County is hereby directed to transmit a certified copy of this resolution, with the proposed Resolution of Intention attached, and a certified copy of the boundary map showing the boundaries of said M1'ancrove Avenue Assessment District, to the City Clerk of the City of Chico, Butte County, California. _, Ch ixman o the Board of Supervisors ~ ~ ~ I fiEREBY CERTIFY that the foregoing Resolution was duly" and regularly adopted by the hoard of Supervisors of the County of Butte, State of California, at a regular meeting thereof, held on-the 21st day of March, 1967, by the following vote, to twit: AYES: Supervisors nunaway Maxon McKillop, Prvde and Chairman Howsden NOES: Supervisors Nnae ABSENT: Supervisors None JE ~ ROG~RS, Co my Clerk, County of Butte, State of California. N=ith asphaltic concrete surfacittn, storm drarnage facilities, and all necessary appurtenances for the herein described improvements, including removing and replacing exi-sting facili-ties and removing and disposing of all refuse and surplus materials, together taith t}:c acc}uisition of any rights of way or easements necessary thereto. BE IT FURY{-lER RI;SOLVI;D that• said improvements be constructed in the streets, avenues, roads, lanes, courts, daces and/or public taays, and in the particular locations set forth and shoran on the plans and specifications on file in the office of the County Clerk of the County of Butte; together with the construction of all appurtenances thereto, all in the particular locations as the same are shot:m on the plans and specifications on file in the office of the County Clerk of the .County of Butte. That the locations of the works to be constructed pursuant to this Resolution of Intention are shown upon the plans and specifica- tions tahich are on file in the office of the County Clerk of the County of Butte, and said plans and specifications are referred to for the specific locations of the taorks and structures to be constructed. That the structures and work and improvements herein de- scribed are to be constructed to the grades and sub-grades and eleva- tions which are sho~~~n anon the plans and specifications tahich are on file in t}re office of the County Cler}: of the County of Butte. All of the taork shall include, taithout duplication, any and all streets, intersections, terminations and opposite terminations occurring taithin the limitations of said work. -1- ~~°~ The attention of all persons is directed to the fact that ali of said classes of work above described may not be constructed upon all of the streets and/or public ways above described in their entirety, but only upon t~~e particular locations as shown in the plans and specifications hereinabove referred to, to which the atten- tion of all persons is directed for a description of the work, location of the several classes of work, a description of the classes of work to be done upon each of the several public streets or rights-of-way named, a description of the streets and rights-of-way, and far alI othex information contained in the said plans and specifications hexeinabove referred to pertinent to the doing and completion of the work -and improvements herein proposed; and 19HEREAS, said contemplated work and improvements, in the opinion of this Board of Supervisors of the County of Butte, is of more than local or ordinary benefit, said Board of Supervisors here- by makes the expenses and costs of said work and improvements charge- able upon a district, which said district said Board of Supervisors hereby declares to be the district benefited by the work and improve- ments herein described; said district shall include that territory in the County of Butte, State of California, which is shaven on that cer- tain plat or map on file in the office of the County Clerk of the County of Butte, and which is entitled and described, "Proposed Boundaries, A4angrove Avenue Assessment District, County of Butte, State of California," and which said map or plat indicates by a boundary line the extent of the territory included in the proposed district, and covers aI1 details as to the extent of the area to be assessed; said map or plat is, by t}iis reference, incorporated herein and made a part hereof. Excepting from the area shown and delineated on said map o.r plat hereinabove referred to the area of all Fublic streets, avenues, lanes, roads, drives, courts, places, public parks, and all easements and ri,s,hts-of-4vay therein contain^d helonRlnR to the public, -~- and also excepting from the area shown and delineated on said map all property owned by the United States of America, the State of California or the County of Butte, and any other public agent manila- ' tory of the Government, school board, educational, penal or refoxm institution or institution for the feebleminded or the insane w}iich is in use in the performance of a public function, and also specifi- cally excepting thexefxom any property belonging to the United States of America or the State of California, lvhether in use in the performance of a public function or otherwise. NOTICE IS HEREBY GIVEN that serial bonds shall be issued in the manner and foam provided in Part 5, Division 7, of the Streets .and Highways Code of. the State .of California (Improvement Act of 1911) to represent unpaid assessments of Fifty Dollars ($50.00) ox over, which said bonds shall~beax interest at the rate of. not to exceed six per cent (6%) per annum, the last installment of which bonds shall mature fourteen (14) years Exam the 2nd day of January next succeeding the next September 1st following theix date. Said bonds shall be payable to bearer, and may be redeemed as provided in the Improvement Act of 1911, and there shall be added to the redemption clause in said bonds the following words: ".....together with a premium of five per cent (5%) of the unmatured principal." NOTICE IS HEREBY given that the total estimated cost of the entire project and the total estimated amount to be assessed upon the properties benefited is the sum of ~ NOTICE IS HERI~BY given that "Monday, the _day of . 19 at the hour of o'clock A.bi. of said day, at the meeting place of the Board of Supervisors of the Cotmty of Butte, located in the Butte County Courthouse, Chico, California, any and all Persons having any objections to the grades to which said work is proposed to be done, or to the boundaries of the district proposed to be assessed to pay the cost and expenses of said work, may appear before said Board. of Supervisors and show cause Svhy said improvements s}could not be carried out in -3- accordance with this Resolution of Intention, and may present _ written protest not later than the hour hereinabove set for hearing against the doing of said work,:the grades to iohich said work is ±o be done, or the extent of the territory to be assessed to pay the cost and expenses thereof. The County Clerk of the County of Butte shall cause this Resolution of Intention to be published twice in the ,,a daily newspaper of general circulation published and cixculated in the County of Butte, which said ne~ti~spaper is hereby designated as the newspaper in which shall be printed and published all notices, resolutions, orders and other matters required to be published in the proceedings taken pursuant to this Resolution.of Intention and under the provisions of the said "Improvement Act of 1911", and amendments thereto, the first publication of said notice to be not less than ten {10) days prior to the date herein fixed for hearing on this Resolution of Intention. . The County Surveyor shall cause to be conspicuously posted along the line of said contemplated work and improvement, and o:~ all the open stxeets within the assessment district, notice of the passaJe.of this Resolution of Intention, in the time, form and mannex required by law.
