HomeMy WebLinkAbout67-0651 2 3 4 5i 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 2S 26 27 28 29 30 31 32 RESOLUTION NO . 6 7 -~+5' BOARD OF SUPERVISORS COUNTY OF BUTTE, STATE OF' CALIFORNIA RESOLUTION OPPOSING ASSEMBLY CONSTITUTIONAL AMENDMENT ~k33 WHEREAS, this board has been advised of the submission of Assembly Constitutional .Amendment #33, which was introduced by Assemblyman Burton on February 28, 1967, and thereafter referred to the Committee On Governmental Efficiency and Economy; and WHEREAS, the proposed Constitutional Amendment, as set out by Assemblyman Burton would change and modify the oath given by all public officers; and WHEREAS, this proposed Constitutional Amendment would elimin- ate any reference to a promise by the party taking the oath that he is not a member of any organization, political or otherwise, thr advocates the overthrow of the government of the United States or of the State of California by force or violence, or other unlawful means, and that further promises he will not become a member of such organization; and WHEREAS, this board believes that the present oath is bene- ficial to the people of the County of Butte as well as to the remainder of California; and WHEREAS, this board .believes that affiants assuming important positions of public trust should be required to solemnly swear, as they have traditionally, and to promise, as they have traditionall not to overthrow the government of the United States or the State of California by force or violence or unlawful means, and that affiant does nat advocate or is a member of an organization, poli- tical or otherwise, with that aim;-and WHEREAS, this board believes that should an individual be unable to ethically, and in all moral honesty, solemnly swear to the oath presently in Section 3, Article xX of the Constitution of the State of California, then that individual should not be allowe to assume a position of public trust; and WHEREAS, loyalty oaths such as we presently have were not t 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 controversial until the advent of Communist philosophy and politi- cal ethics, this board can only question why it is either necessar or beneficial to amend the present oath as set forth in the Con- stitution, or even why the proposed amendment was introduced, NOW, THEREFORE, BE IT RESQLVED by the BOARD OF SUPERVISORS OF THE CE9UNTY OF BUTTE as follows: 1. That this board firmly opposes Assembly Constitutional Amendment No. 33 and respectfully submits to the .Assembly and the 'Senaterof the State of California that this proposed Constitution Amendment should be defeated. 2. That copies of this resolution be forwarded to Assemblym~ Ray Johnson, to Senator Fred Marler, and to all other interested parties designated by the board.
