HomeMy WebLinkAbout67-068RESOLUTION NO. 67-~ BOARD OF SUPERVISORS l COUNTY OF BUTTE, STATE OF CALIFORNIA 2 RESOLUTION AUTHORIZING ACQUISITION OF REAL PROPERTY BY EMINENT DOMAIN NECESSARY FOR THE CONSTRUCTION OF A COUNTY 3 HIGHWAY KNOWN AS CONCOW ROAD IN THE COUNTY OF BUTTE, STATE OF CALIFORNIA 4 ~ SE IT RESOLVED by the Board of Supervisors of the County of 6 Butte, State of California, that said board finds and determines 7 and hereby declares, as follows, to wit: 8 1. That public interest and necessity require the acquisit 9 ion, construction and completion by the County of Butte, of a 10 public improvement, namely a county highway known as Concow Road, 11 in the County of Butte, State of California. 12 2. That public interest and necessity require the acquisit 13 ion for said improvement of the real property, or interest in the 14 real property hereinafter described, together with a 11 improvement 15 situate thereon, and it is hereby found and determined that the 16 construction of a county highway is a public use, authorized by 17 law, and that public interest and necessity require the construct- 18 ion of said improvements and the acquisition of said real property 19 hereinafter described, and all improvements situate thereon. 20 3. Said proposed public improvement is planned and located 21 in a manner which will be most compatible with the greatest 22 public good and the least private injury. 23 4. That the County Counsel of the County of Butte is 24 hereby authorized and empowered as follows: 25 (a) To acquire, in the name of the County of Butte, a 26 fee simple estate or such necessary interests in and to the 27 hereinafter described real property, or interest in real property, 28 and all improvements thereon by condemnation in accordance with 29 the provisions of the Streets and Highways Code, Code of Civil 30 Procedure and the Constitution of the State of California, r elatin 31 to eminent domain, to authorize the auditor to pay from County 32 funds the costs and consideration for said acquisition, and the 1 auditor is authorized to make such payment on authorization. 2 (b) To prepare and prosecute for the County of Butte such 3 proceedings in the proper court having jurisdiction thereof, and 4 make such deposits from County funds for fees and costs as are 5 necessary for such acquisition. 6 (c) To mJ.ke application to said court for an order fixing 7 the amount of security in the way of moneys deposited as said 8 court may direct, and for an order permitting the County of Butte 9 to take immediate possession and use of said real property, or 10 interests, or improvements in said real property, as a right of 11 way for a public highway for public use. 12 (d) To make deposit of such security out of proper funds 13 under the o~ntrol of the County of Butte, in such amounts as fixed 14 and determined and in such manner as said court in which condemn- 15 anon proceedings are pending may direct, and the Auditor is 18 authorized to make said deposit immediately upon the court making 17 said order. 18 5. The real property, or interest in real property, and/or 19 improvements thereon, which the County of Butte is, by this 20 resolution, authorized to acquire for said public improvements in 21 fee simple, is situate in the County of Butte, State of California, 22 more particularly described in Exhibit "A", attached hereto and 23 made a part hereof by reference as if set forth in full. 24 PASSED AND ADAPTED by the Board of Supervisors of the Count 25 of Butte, State of California, this 25th day of April, 1967, by the 26 following vote: 27 AYES :Supervisors Dunaway, Maxon, McKillop, Pryde and Chairman Howsden 28 NOES: None 29 ABSENT: None 30 ATTEST: AR E.
