1o That Amendment No, 23 to DWR Agreement No, 353760 is hereby

approved and the Chairman of this Board is authorized to execute and sign said
amendment on behalf of the County of Butte,
2e That County' by its approval of this Amendment No, 23
to DWR Agreement Noe 353760, does not conoede that County is not entit3.ed to
re~nbursement, and, furtherp an amendment increasing the m:~cimum payable to
County under said DI3fi. Agreement No< 3537608 by reason of ebange orders hereto-
fore, or hereafter, made to County's Contract No, 27561-55--Z witfl Piambo Con-
atruction Company and Piombo Corporation, J/~Ig and ~rhich change orders are not
included in this amendments or other amendmentsa by reason of Department of
Water Resources' denial of County's request for reimbursement, and County
specifically reaeraes any and a7.3. rights, that County may ha~re against Depart-
ment of Water 'Resources and State of California, for re5mbursement on such
change orders that have not been included as amendment to DWR Agreement Noa
353760a
3e That the Clerk of tkcis Board shall certify and attach a copy of
this resolution to the original and all copies of Amendment Noa 23
to DWR Agreement No, 353760e
