HomeMy WebLinkAbout67-158COUNTY OF BUTTE BUTTE COUNTY SERVICE AREA NO. 26 RESOLUTION NO .' 67-158 RESOLUTION CANVASSING VOTES CAST AND ASCERTAINING AND DECLARING RESULTS OF SFECIAL BOND ELECTION 2N BUTTE COUNTY SERVICE AREA N0. 26 WHEREAS, the Board- of Supervisors of the County of Butte has duly passed and adopted on July 18, 1967, Resolution No. 67-135 calling a special bond election in Butte County Service Area No. 26 on October 17, 1967, fox the purpose of submitting to the qualified electors thereof the measure hereinafter specified; and WHEREAS, notice of said election was thereafter duly given as required by law and by said resolution, as more fully appears from the affidavits on file with this Board of Supervisors; and WHEREAS, it appears that said election was duly held in accordance with law and with said resolution on October 17, 1967, as aforesaid, that the polls for said election were kept open during the time required by law; and that said election was held and conducted, and the votes thereat received and canvassed and the results thereof ascertained, determined and declared, all as provided by the laws of the State of California and by said resolution; and WHEREAS, an this date this Board of Supervisors met at its usual meeting place and has canvassed the returns 1. of said election as required by law and the result of said canvass is found to be as hereinafter stated and set forth; NOW, THEREFORE, BE IT RE5OLVED BY THE BOARD OF SUPERV3SORS OF THE COUNTY OF BUTTE, AS FOLhOWS: 1. The foregoing recitals are, and each of them is, true and correct and this Board so finds and determines. 2. At said election held on Tuesday, October 17, 19b7, the following measure for incurring bonded indebtedness was submitted to the qualified electors of Butte County Service Area No. 26 and the number of votes cast and the number of votes counted for and against said measure (including absentee votes) were as follows: MEASURE: Shall Butte County Service Area No. 26 incur a bonded indebtedness in the sum of $900,000 for the pur- pose of the acquisition, construc- tion and completion of facilities for the collection, treatment and disposal of sewage of Butte County Service Area No. 26 and its in- habitants, comprising main trunk lines, pipes, pumps, machinery, lands, easements, rights of way, and other works, property or structures, useful or necessary for the collection, treatment or disposal of sewage of said Butte County Service Area No. 26 and its inhabitants Total Total Total Ballots Total Votes Votes Spoiled and Votes "YES" "NO" Not Counted Cast 621 ~~2 1158 3. Resolution No. 67-135 calling said election provided that for the purpose of said election the county service area shall be divided into three (3) consolidated-precincts, and that the number of votes cast in each of said precincts for and against said measure was as follows: 2. All absent voter ballots have been duly received and canvassed in time, form and manner as required by law, and the result of the absentee vote for and against said measure is as follows: Absentee Vote Absentee applications filed 48 Ballots returned (total vote cast) 48 Votes rejected (ineligible) 2 Spoiled Ballots 0 Ballots counted (regular) 46 Absentee Vote "YES" 27 Absentee Vote "NO" 19 Total Absentee Vote 46 5. That less than two-thirds of all of the votes cast at said election were in favor of said measure and authorized the incurring of a bonded indebtedness for the purpose set forth therein and that said measure failed 6. The Clerk is hereby instructed to enter this resolution on the minutes of this Board of Supervisors as a statement of the result of said election. PASSED AND ADOPTED this 24th day of October, 1967, by the following vote: 3. CLERK`S CERTIE`ICATE I, JESSIE ROGERS, County Clerk of the County of Butte, California, do hereby certify as follows: The foregoing is a full, true and correct copy of a resolution duly adopted by the Board of Supervisors of said County, at a regular meeting of said Board duly and regularly and legally held at the regular meeting place thereof on October 24, 1967, of which meeting all of the members of said Board had due notice and at which a majority thereof was present. At said meeting said resolution was introduced by Supervisor McKillop and read in full, and was thereupon, upon motion of Supervisor McKillop , seconded by Supervisor i~Taxon adopted by the following vote: AYES: Supervisors Dunaway, Maxon, McKillop, Pryde and Chairman Howsden NOES: None ABSENT:None I have carefully compared the same with the original minutes of said meeting on file and of record in my office and said resolution is a full, true and correct copy of the original resolution adopted at said meeting and entered in said minutes. The original resolution has not been amended, modified or rescinded since the date of its adoption and the same is now in full force and effect. Dated: October 24th 1957.
