TD DWlt AGREg+IENT NO 353760 BE IT RESOLVED BY THE BOARD OF 5U'PERVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, as follows: le That Amendment No, !~ to DWtt Agreement No. 353760 is/ hereby approved and the Chairman of this Board is authorized to execute and sign said amendment on behnlf of the County of Butte, 2a That County, by its approval of this Amendment No. 3L~ to DWR Agreement No, 353760, does not concede that County is not entitled to reimbursement, and, further, an amendment increasing the maximum payable to County under said DWR Agreement Non 353760, by reason of change orders hereto- fore, or hereafter, made to County's Contract No. 29561--65-1 with Piombo Con-- atruction Company and Piombo Corporation, ~/y; and which change orders are not included in this amendment, or other amendments, by reason of Department of Water Resources' denial of County's request for reimbursement, and County specifically reserves any and all rights, that County may have against Depart- went of Water Resources and State of California, for reimbursement on sucks change orders that have not been included as amendment to DWR Agreement No, 353760, 3o That the Clerk of this Board shall certify and attach a copy of this resolution to the original and all copies of Amendment No, 9~ to DWR Agreement No, 353760. ....
