RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OR BUTTE APPROVING AGREEP~NT REGARUIid(~ A FREEWAY ON ROAD 03-BUT-99 BETWEEN BUTTER COUNTY LIRE ANA OROVILLE WYE WHEREAS, an Agreement has been presented covering the con- struction and maintenance of a freeway on road 03-But-99 between Sutter County Dine and Oroville Wye WHEREAS, the Board of Supervisors has heard read said Agreement in full and is familiar with the contents thereof; THEREFORE, be it resolved by the Board of Supervisors of the County of Butte that said Agreement is hereby approved and Supervisor _ u„~,.,~,~,, is directed to sign the same in behalf of the County of Butte . NOW THEREFORE, it is agreed: 1. The County agrees and consents to the closing of County roads, relocation of County roads, construction of frontage roads and other local roads, and other construction affecting County reads, all as sho~s*n on the plan map attached hereto marked Exhibit "A", between Sutter County Line and Oraville Wye and made a part hereof by this reference. -~~ 2. The State in the construction of said freeway will, at the State's expense, make such changes affecting County roads in accordance with said plan map attached hereto or as the same may heresiter be modified by mutual agreement. between the parties hereto. The State may, at the State's expense, install sign, signals and other traffic control devises at appropriate loca- Lions to be determined by the State in order to regulate, warn or guide traffic upon the highways. 3. The County will accept control and maintenance over each of the relocated or reconstructed County roads and the frontage roads and other State constructed local roads on notice to the County Road Commissioner from the State that the work thereon has been completed, except as to any portion thereof which is adopted by the State as a part of the freeway proper. The County will also accept title to the portions of such roads lying outside the freeway limits, upon relinquishment by the state. 4. The State agrees to acquire all necessary right of way as may be required for construction, reconstruction or alteration of County roads and frontage roads, and the County hereby authorizes the State to acquire in its behalf all such necessary right of way. 5- Tk~e grade separations shown on plan mag Exhibit "An will either be underpasses ar overpasses as detailed engineering studies may determine will best fit the locality.
