RESOLUTION OF pREI,IMINARY DETERP4INATIOI~I TIiAT THE
PUBLIC COI7VENIENCE AND•NECESSITY REQUIRE THE
CONSTRUCTION OF IMPROVEN(ENTS AND ACQUISITIONS IN
EAST AVENUE ASSESSMENT DISTRICT, COUNTY OF BUTTE,
• CALIFORNIA
BE IT RESOLVED by the Board of Supervisors of the
County of Butte, State of California, as follows: •
1. That there has been filed with this Board of Super-
. visors a petition signed by the owners of more than 60 per cent
of the area of the property within the boundaries of the pro-
posed assessment district outlined in the map which is on file
in the office of the County Clerk of the County of Butte, and
entitled, "Proposed Boundaries of East Avenue Assessment Dis-
trict, County of Butte, State of California," that said petition
requests that special assessment district proceedings be instituted
to construct certain improvements and acquisitions within the
boundaries of said district, and that the cost and expenses
thereof should be assessed upon the property within the boundaries
of said district.
2. Preliminary determination is hereby made that the
public convenience and necessity require the following improve-
ments and acquisitions to be made and paid for by special assess-
ments levied-upon the property benefited and that necessary
special assessment proceedings should be taken therefor.
3. The nature of the proposed improvements and acqui-
sitions consists of the construction of concrete curbs, gutters,
driveway aprons, sideti•~alks, and all necessary appurtenances for
the herein described improvements, including removing and re-- •
placing existing facilities and removing and disposing of all

refuse and surplus materials, together with the acquisition
of any land, easements or rights-of-way necessary thereto.
4. The cost and expenses of the payment of said
improvements and acquisitions will be borne by an assessment
district which shall be known and designated as East Avenue
Assessment District, County of ButtB, State of California, and
the boundaries of said district are hereby shown upon that cer-
tain map on films in the office of the County Clerk of the
County of Butte, and designated, "Proposed Boundaries of East
Avenue Assessment District, County of Butte, State of California."
5. It is further determined that ,dALTER B. GRIP~IES,
Civil Engineer, shall be Engineer of Gdork in accordance with
the terms and conditions of letter from said LdALTER B. GRIMES,
which said letter is on file with the proceedings. It is further
ordered that STURGIS, DEN-DUCK, DOUGLASS & ANDERSOIQ, Attorneys at
Law, shall be Special Bond Counsel to prepare all proceedings in
accordance with the terms and conditions of letter from said
STURGIS, DEN-DUCK, DOUGLASS & ANDERSON, which said letter is on
file with the proceedings.
6.. Said special assessment proceedings are to be taken
under the provisions of the Improvement Act of 191.1 of. the State
of California, with bonds to be issued under the provisions of
the Improvement Act of 1911.
7. 44ALTER B. GRIi2ES, Civil Engineer, is hereby appointed
Engineer of PTork for the doing of all necessary engineering work
and exercising all of the functions provided for the office of
Engineer of t~ork and Superintendent of Streets under the Improve--
ment Act of 1911, and he is herebv authorized to sign all docu-
•. ments required to be signed by the Engineer of ~,7ork of said
assessment district.-

I HEREBY CERTIFY that the foregoing Resolution was
duly and regularly adopted by the Board of Supervisors of the
County of Butte, State of California, at a regular meeting
23rd
thereof, held on the filch day of April, 1968, by the following
vote, to wit:
AYES: Supervisors Dunaway, Howsden, McKi].lop, Pryde & Cha3sman Maxon
NOES: Supervisors None
