RESOLUTION N0. 68-~8 BOARD OF SUPERVISORS COUNTY OF BUTTE, STATE OF CALIFORNIA RESOLUTION RELATIVE TO FEDERAL PARTICIPATION TN WELFARE PAYMENTS TO NONRESIDENTS WHEREAS, the Federal Social Security Act since its enact- ment in 1935 has permitted the various states to impose reasonable residence requirements for eligibility to the various public assistance programs whose costs are partly paid by federal funds; and WHEREAS, the Federal Social Security Act so provides at the present time, with California having consistently required a reasonable continued residence as an eligibility factor for permanent public assistance payments; and WHEREAS, a federal court in California and other federal courts in other parts of the nation have declared the unconsti- tutionality of such residence requirements alleging that they contravene the "equal protection of the law" guarantee of the Federal Constitution and that they unduly restrict the freedom of Americans to travel at will within the country; and WHEREAS, if this new judicial theory is upheld by the United States Supreme Court, state and county costs of public assistance in California will be tremendously and permanently increased; and WHEREAS, the County of Butte feels that a considerable number of people who do not presently reside within California or the County of Butte and who ordinarily would have no intention of moving, will forthwith locate in the County of Butte and the State of California solely because California offers a much .higher welfare stipend than does the majority of its sister states; and WHEREAS, migration will undoubtedly cause a depletion of budgeted funds for indigent aid, and in general deplete the county funds to the extent that other necessary public functions and services will be severely affected; and 32 I 10 11 12 13 14 15 16 17 18 19' 20 '~ 21 22 23 24 23 26 27 28 29 30 31 32 WHEREAS, the irreparable injury that may be caused from these decisions will be an irreparable injury to the taxpayers of the County of Butte and the State of California, NOW, THEREFORE, BE TT RESOLVED that the Board of Supervisor of the County of Butte request the President and the Congress of the United States to amend the Federal Social Security Act at once as an urgency measure so as to .-:,,provide a reinstatement of the residency requirements for welfare recipients, however, if this cannot be accomplished, that the Federal Social Security Act be amended so as to provide full federal financing of the public assistance payments made to recipients who do not meet the length of residence requirements presently permitted by federal statute and contained in the California Welfare and Institutions Code. Johnson, the Honorable George Murphy, the Honorable Thomas Kuchel, and to such other interested parties as this board may designate.
