G ~ ~~ RESOLUTION OF INTENTION RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA: 'That it is the opinion of this Board that the public interest and convenience of this Board to order t done and improvements to rights of way and public to wit: require and that it is the inf,€ntion he following described work to be be constructed in certain places, roads in the County of Butte, That East Avenue from a point ~p feet Westerly from its intersection w centerline of California State Route 99 Freeway to a point /6 BO feet Westerly therefrom be improvec~~onstructing thereon curbs, gutters, sidewalks., drainage facilities and all necessary appurtenances. That the South 1/2 of East Avenue from a point ~ G ga feet Westerly from its inter- section w-itT~'al ifornia State Route 99 Freeway to a point /830 feet Westerly therefrom be improve~Ic.`by constructing thereon curbs, gutters, sidewalks and drainage facilities and all necessary appurtenances. -~.- That all of said work shall be done and said improvements shall be constructed pursuant to Division 7 of the Streets and Highways Code of the State of California, the Improvement Act of 1911, as amended, and shall be of the sizes, dimensions, materials, and in the positions and loca- tions and to the grades as shown and described upon and all in accordance with the plans and specifications for East Avenue Assessment District, approved by this Board on May 28 ~ 1968, and now on file in the office of the Clerk of this Board. That in the opinion of this Board of Supervisors the public interest will not be served by allowing the property owners to take the contract to perform the work of improvement herein described, and such property owners shall not be permitted to enter into a written contract to do said work. That it is the opinion of this Board that said work and improvements are of more than local and ordinary public benefit and that this Board hereby orders that the costs and expenses of said work and improvements shall be charged upon a District and that this Board hereby declares that said District is the District to be benefited by said work and improvements and that said District shall be assessed to pay the costs and expenses of said work and imp rovements. That the exterior boundaries of said District and the extent of the territory included therein are shown upon the map of said East Avenue Assessment District adopted and approved by this Board on May 28 1968. That said map is now on file in the office of the Clerk of this Board and this Board hereby refers to said -2- map and to the Resolution approving said map for a particular description of the boundaries of said District and extent of the territory included in said District, and that this Board hereby declares that the area of all public highways, streets, and roads included in said District is excepted from said District. THAT THIS BOARD HEREBY GIVES NOTICE that Serial Bonds, made payable to bearer, shall be issued pursuant to Part 5, Division 7 of Streets and highways Code to rep- resent unpaid assessments of $50.00 or more, and that said bonds will bear interest at the rate of six percent (6%) per-annum and that the last principal installment due on said bonds shall mature fourteen (14) years from the 2nd day of January next succeding the 1st day of September following their date, and that the redemption provisions of said bonds shall provide a premium of five percent (5%) of unmatured principal if redeemed before maturity. THAT THIS BOARD HEREBY GIVES NOTICE that it sets ;~_,,~ Tuesday, June,,2~ _ 1968, at the hour of 11:00 0' clock ~'~ A.M. in the Chambers of the Board of Supervisors of the County of Butte in the Butte County Courthouse in the City of Oroville, California, as the time when and the place where any and all persons having any objections to the proposed work and improvements herein described may appear before this Board and show cause why the proposed work and improvements should not be carried out in accordance with this Resolution of Intention, and THAT THIS BOARD HEREBY GIVES NOTICE that any owner of property liable to be assessed for said work and improvements may, at any time not later than the hour set for hearing objections to said -3- work and improvements, make and file with the Clerk of this Board a written protest against the proposed work and improvements, or against the extent of the District to be assessed, or both. That the Clerk of this Board shall cause this Resolution of. Intention to be published twice in the Enterprise-Record. a newspaper published and circulated in said County of Butte, which said newspaper is hereby designated for that purpose and which is hereby designates as the newspaper in which all further notices required to be made herein shall be published. That the Clerk of this Board is hereby directed to mail notices of the passage of this Resolution of Inten- tion to all persons owning real property which is to be assessed to pay any part of the cost of the work and improve- ments hereinabove described. That the Engineer of work shall, in the time, form and manner provided by law, cause notices of the passage of this Resolution of Intention to be conspicuously posted along the lines of the work and improvements described herein and on all the open streets within the District above described. PASSED AND ADOPTED BY THE BOARD OF SUPERVTSORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, 'I'EiIS 2$th DAY OF MAY 1968, by the following vote: AYES: SUPERVISORS DIJNAWAY~ P4cKTLhOP~ PRYDE~ and CN~IIRMAN MAXON NOES: SUPERVISORS NONE.
