GENERAL This Ordinance may be known and cited as the Butte County Trailer Park Ordinance'` It is the intent of this Trailer Park Ordinance to prova.de regulations and standards for the establishment and enlarge- meet of trailer parks and the use of trailer coaches in the unincorporat- ed area of Butte County that equal or exceed all applicable State Laws. This Ordinance is adopted to promote the general health, safety and wel- fare of the inhabitants, residents and property owners of Butte County and to provide the occupants of trailer coaches therein with suitable. living environments. This Ordinance shall apply to any lot or~parcel of land in the unincorporated area of Bntte County designed for, used or intended to be used for the parking and use for liva.ng quarters of two (2} or :more trailer coaches, regardless of whether or not a charge is made for such- aecommodation, Unless the context of this Ordinance otherv~se requires, the terms '"trail-er coaoh" and trailer parkr as need herein shall have the same meaning and definition as prescribed in Chapter 1, part 2g division 13 of the Health and Safety Code of the State of'California. SECTION 2. ESTABLISHMENT OR ENLARGEMENT OF TRAIZER PARKS A. Permit to Establish ~~- Any person desiring to establish or enlarge a trailer park shall obtain a Use Permit from the Butte County Board of Supervisors authorizing him to do so. A trailer park shall be deemed to be enlarged when additional buildings or trailer sites or accommodations for additional trailer coaches are established in the park or when reconstruction exceeds twenty five percent (251} of the assessed valued B. Applicati®n for Use Permit .»-. Any person desiring to estab- lish or enlarge a trailer-park shall file an application with the Butte County Planning Commission on forms provided. The applioation for the trailer park or enlargement thereto shall. contain the following information: 1. Name of applicant and a11. pexsons to be directly responsible if the permit is granteds 2Q The resident and business address of the applicant. 3e Whether the applicant is the owners lessee or option holder of the property and state the existing use of the land. ~.. A scale description of the property proposed for the trailer parks 5. The source of water supply. 6, Such additional information as may be required by the various departments of the County of Butte. 7. The methad proposed for disposal of sanitary waste. C. Application Fee -~ The Application Fee for a Use Permit to establish or enlarge a trailer park shall be X25.00 or such other amonnt as may from-time to tame be established by resolution of the Board of Supervisors no part of which shall be returned to the applicant, payable bn sub~.ssion of the application.. ~/ D: Referrals -- Copies of the appli~:ation and the plot plan and other drawa.ngs and cross sections wha.ch have been submitted with the application shall., upon receipt by the Planning Commissionx be referred to the following agencieso 1. County Building Official 2, County Health Department 3. State Division of Housing E. Investigations -- Upon the receipt of plans from the Planning Commissions the County Bu.~.lding Official, County Health Depart- ment and the State Division of Housing shall make necessary investi- gation and report their recommendations to the Planning Commission. F. Public Hearings -- Upon receipt, in proper form, of an' application for a Use Permit to establish. or enlarge a trailer park the Planning Commission may kzold a public hearing thereon, notice of wl~ch shall be given by publication in a newspaper of general circulation in the County, once, at least ten (10) days prior to the date of such hear- ing, Such hearing may be waived by the Planning Commission. G. Planning Commission°s Powers -- The Planning Commission shall make recommendation to the Board of Supervisors on trailer park permits valid for a specified term upon a finding by it that the grant- ing of such permit is compat~.ble nth the area and will not; under any circumstances of the particular case, materially affect adversely the health, safety and welfare of persons residing or working in the neighborhood of the property of the applicant and w3.11 not under the circumstances of the particular case be materially detrimental to the public welfare or injurious to persons or improvements in the neighbor- hood, H. Expiration of Permit -.- A trailer park permit issued by the Board of Su ervisors shall expire and become void after the expir- ation of one (l~ year from the date of issuance, if construction, pursuant to such perm9.t, is not commenced and pursued with reasonable diligence within such per~:od. I. Suspension and Revocation -- Any permit to operate a trailer park graixted hereunder may be revoked or suspended upon ten (10) days ~rx°itten notice by the Board of Supervisors upon any one of the following conditionse to The' violation of any provision of this ord~.nance. ~. Fraud in obtaining the permit to operate. 3. For conducting and operating the trailer park in such manner as to constitute a menace to the public peace, healthy safety and welfare. SECTION 3. DESIGN STANDARDS Any person desiring to establish a trailer park or to .enlarge an existing trailer park shall, in the submission and execution of plans for Suoh trailer park, comply with the following minimum design standardsa A. Area Requirement -- Trailer parks established after the effective date ~sf this Ordinance shall be developed on a parcel of at least three (3) sores and shall be on a site properly graded to provide adequate drainageo B: Trailer Coach Site Requirement -- Each trailer coach site shall have an area not less than two thousand (2,000) square feet. -2- C, Minimum Side Yards and Rear Yard: Seven (7) feet, D, Minimum Setback Required: Fifty {50) feet from the center- line of all County roadso E, Enclosure of Trailer Park -- A wall or fence six (6) feet in height shall be erected and maintained along each side and rear boundary of the trailer park, except along the portion of such side or rear boundary line wha.eh either abuts a public street or is within a front yard or side yard ad3acent to a streeto A wall or fence shall be solidfl of woods concretes brisk or any masonry constructions or of chain-link metal construction with an evergreen hedge planted and main- tained at the height of six (6) feete SECTION fro REGULATIONS FOR EXISTING TRAILER PARKS Trailer Parks in existence on the effective date of this Ordinance, which are operating under a valid permit issued by the State Division of Housings shall continue to operate under the rules and i°egulations in effect and promulgated by the State Division of Housingo The ruless regulations and conditions set forth in this Ordinance shall not apply to such trailer parkas Howevers if such trailer park is en- larged or reconstructed to exceed twenty-five (25) percent of assessed values all provisions of this~Ordinance shall apply and be in full force and effects except Section 3As the three (3} acre m~.nimum area required, SECTION 5o VARIANCE Where hardship can be shown by the applicant in meeting the standards of this Ordinance or conditions existing which make compliance with any rules dxisting impracticables the Planning Commission may recommend the Board of Supervisors modify or amend any minimum re- quirement set forth in this Ordinanceo SECTION 6, REPEALING All ordinances and parts of ordinances of Butte County in con- flict with this Ordinance to extent of such conflict and no furthers are hereby repealede SECTION 7a VALIDITY If any sections sub-sections sentences clause or phrase of this Ordinance is for any reason held by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the re- maining portion of this Ordinanceo SECTION $, VIOLATION Any person Tniho v3.olates any provision of this Ordinance is guilty of a misdemeanor and punishable by fine or imprisonment, or by both such fine and imprisonments SECTION 9o ENACTMENT This Ordinanoe shall be and it is hereby declared to be in full force and effect from acid after thirty {30) days after the date of its passages and before the expiration of fifteen (15.} days after its passage this Ordinance shall be published once with the names of the ®3~ Board members voting for and against its. in Paradise Press s a newspaper of general circulation published in t3ie County of Buttes State of California. 1~ASSED AND ADOPTED by~the Board of Supervisors of th.e County of Buttes State of California, this 8th day of Au~u.st ti960f by the following vote: AYES: Supervisors Alldredge, Giles, Huggins, McKernan and Chairman Pryde.
