BOARD OF SUPERVIDOR~
COUNTY OF BUTTE, STATE OF CALIFORNIA
RESOLUTION ENDORSING JOHN C. MONTGOMERY'S OPPOSITION
TO FEDERAL REGULATION TO PROVIDE LEGAL SERVICES TO
APPLICANTS FOR WELFARE FAIR HEARINGS AND FOR CONTINUED
AID PAYMENTS PENDING THE APPEAL
WHEREAS, the federal Department of Health, Education and
Welfare has proposed a regulation requiring legal services for
appellants and continuing assistance during appeals in welfare
cases, to become effective July 1, 19b9; anal
WHEREAS, this new proposed regulation was vigorously
opposed by Mr. John C. Montgomery, Director of the State Depart-
ment of Social Welfare, which opposition was clearly and
concisely set forth in his letter dated December 11, 1968,
directed to the Department of Health, Education and Welfare; and
WHEREAS, Mr. Montgomery should be commended for his forth-
right defense of local government and the bringing to light for
all to see the creeping mounting administrative expense to local
government resulting from these sophisticated federal welfare
state benefits; and
WHEREAS, ineligible persons who deliberately violate or
abuse the program according to controlling law may be paid public
assistance although. the Federal Government does not participate in
such payments forces the local government to abide by a regulation
that is not recognized for financial participation by the Federal
Government, which results in the increase of costs to local tax-
payers,
NOW, THER~ORE, BE IT RESOLVED :,.that the Butte County Board
of Supervisors does hereby cormnend Mr. John C. Montgomery for his
active and vigorous opposition to the federal regulation providing
legal services for appellants and continuing assistance during
appeals in welfare cases.
BE IT FURTHER RESOLVED that the Butte County Board of
Supervisors adopt the intent of this resolution as a policy of

said board, and that the Clerk of this board send a copy of this
resolution to the Honorable Ronald Reagan, Governor of the State
of California, the Honorable Ray Johnson, Assemblyman, the
Honorable Fred Marler, Senator of the State of California, and
all other interested persons.
PASSED AND ADOPTED this 11th day of February, 1959, by
th.e Board of Supervisors of the County of Butte, State of
California, by the following vote:
AYES: Supervisors Etowsden, Maxon, lteyoolds & Acting Chairman Dunaway
