RESOLUTION N0. 69
BOARD OF SUPERVISORS
COUNTY OF BUTTE, STATE OF CALIFORNIA
RESOLUTTON AND ORDER EXCEPTTNG PROPERTY IN THE EL MEBIO
FIRE DISTRICT FROM STRUCTURAL FIRE TAX
WHEREAS, the Ei Medio Fire District, County of Butte, has
petitioned the board of supervisors, in writing, for the exclusion
of property from the levy of taxes for structural fire protection,
which said petition is supposed by a resolution of the governing
body of said district, all in accordance with Section 25643 of
the Government Code of the State of California,
NOW, THEREFORE, BE IT ORDERED AND RESOLVED by the Board of
Supervisors of the County of Butte, State of California, as
follows:
1. That pursuant to the provisions of Section 25643 of the
Government Code of the State of California, all property within
the limits of the El Media Fire District in the County of Butte,
including all property which may hereafter be annexed to said
city prior to tax levy being made thereon, is hereby excluded from
a tax levy to provide funds for structural fire protection of the
areas in the County of Butte.
PASSED AND ADOPTED by the Board of Supervisors of the County
of Butte, State of California, this 18th day of March, 1969, by
the following vote:
AYES: Supervisors Dunaway, Howsden, Maxon, Reynolds & Chairn3an McKillop
NOES : None
ABSENT: None
to County Board of Supervisors

WHEREAS the Bounty of Butte does now, and for many years prior hereto, has
levied a county tax each year upon property within the County, including the
prt~perty within the boundaries of the EL MEDIO FIRE DISTRICT assessed for tax
purposes, to provide county funds for structural fire protection within said
county; and
WHEREAS Government Code Section 256y.3 provides that the Bosrd of Supervi
shall exclude from such tax levy property within the boundaries of any fire
projection district within said county having an organized fire protection
department in operation and existance and providing adequate structural fire
protection within said county; and
WHEREAS the Board of Fire Commissioners of the EL MEDIO FIRE DISTRICT does
now, and for many years prior hereto, has had an organized fire department in
operation and existance which is providing adequate fire protection to all the
property within said district, and no additional benefits in fire protection is
or will be received or required by such property from Structural fire protection
given by the County of Butte,
NOW, TFTEREFORE, BE IT RESOLVID by the Board of Fire Commissioners of the
EL MEDIO FIRE DISTRICT of Butte County, California, as follows, to wit:
1. That such Board do, and it does hereby petition the Board of Supervisor
of the County of Butte, pursuant to the provisions of Section 25643 of the
Government Code of the State of California, to exclude all the property within
the limits of the EL MIDIO FIRE DISTRICT in said County of Butte, including all
property which may hereafter be annexed to said District prior to a tax levy
being made thereon, from a tax levy to ~rovide county funds for structural fire
protection of the areas in the County of Butte.
2, That the Clerk of the Board is directed to certify and forward to the
Clerk of the Board of Supervisors of the County of Butte a copy of this
resolution,
The forgoing resolution was adopted at a regular meeting of the Board of
Fire Commissioners of the EL MEDIO FIRE DISTRICT held on the 20th day of
February, 1969, by a roll call vote of the members as follows:
AYES: ALLEN SIMPSON, ED VICARS, CHAS. JONES, JOE FARMER, JUNIOR S
NOES: NONE
