CHICO I'N~IICIPAL COURT, ARTICLE 37 OF TITLE 8, CHAPTER
10 OF GOVERIvTt'LI~iT CODE.
WHEREAS, the Superior Court of the State of California,
in and for the County of Butte, on March 13, 1969, in the case
of DARRELL THOI~IPSON, et al, vs. ELDRLD E. jdOLFCRD, et al, I`To.
48971, held that the Chico Judicial District has a population in.
excess of 40,000, which Memorandum of Decision is attached hereto
as Exhibit "A"; and
WHEREAS, this board wishes to obtain legislation which is
attached hereto as Exhibit '!B", to properly establish and set
the salaries of the various court attaches,
A?OTrI, THEREFORE BE IT RESOLVED by the Board of Supervisors
of the County of Butte, State of California, as fo17_ows:
1. That this board respectfully requests that the legis-
lation set forth in Exhibit "B", which is attached hereto and
incorporated herein as if set forth in full, be enacted as
emergency legislation so as to be in effect on July 1, 1969.
PASSED AidD ADOPTED this 2j•~h day of Harch 1969,
by the Board of Supervisors of the County of Butte, State of
California, by the following vote:

Will add:
Section 74934. This article applies to the Municipal Court
established in the Chico Judicial District of Butte County.
Section 74935. JUDGE. There shall be o_,° judge.
Section 74936. CLERK. There shall be o~ie cl:er:~ who-shall
::_ecewe ti-ie salary specified in ra=:~,e iVo. 18.
Section- 74937. ADDITIOiIAL CLERKS; APPOIiTTNivI~1T. Ti~:e clerk
may appoint two steno clerks II who shall be deputy clerks and
shall receive the salary specified in range 12, and three clerk
II, who shall- also be deputy clerks and shall receive tine salary
specified~in range 8. Additional deputy clerks may be appointed
as are required, with the consent of the Board of Supervisors of
the County of Butte, and shall receive the salary specified in
range 8.
Section 74938. NtARSHAL , COtiPEDISATION. There shall be
one marshall who shall receive the salary specified in range 28.
Section 74939. DEPUTY MARSHAL; CLERK; APPOI~I'I'NIExdT;
CC:~iPE?~~SATION. The marshal may appoint one. deputy marshal who ,
shall receive t}~e salary specified in range No. 22 and one steno
clerk II who shall receive the salary specified in range 12, and
who shall serve as cleric to the marshal. With the consent of the
Board of Supervisors of Butte County, the ma;:shal may appoint
additional deputies as is required, which additional deputies
.shall receive the salary specified in range 22.
Section 74940. SALARY SCHEDULE. Whenever reference is
made to a range in any section of this article, the follo.aing
schedule of monthly salaries shall apply:

26 INCREASE' OR DECREASE IN SALARIES; Subject to the pro visions of

29 (a) .. The initia l hiring rate for each position shall norra].ly
30 ~be at step 1. If it is difficult to secure qualified personnel at
31 such rate, or if a person of unusu al qualif ications i s hired, tl~e
32 appointing authority; with the app roval of the-Board of Supervisor

3 (b} A step advancement from step 1 to step 2 of a position
a shall be granted on the first day.o~ the month following the
g completion of 6 full months of service in the position. A
g person shall advance to steps 3, 4 and 5 upon completion of
q successive 12 month periods of service in the same position.
g (c) .The salaries of municipal court officers and attaches
9 may, upon recommendation by the appointing authority and approval
i0 of the board of supervisors,. be increased or decreased within the
11 limits set forth in Section 74926-in_order to provide compensatio:
12 which is comparable to compensation received by county employees
13 of similar qualifications and experience and holding equal or
14 comparable positions., as said.compare~bility is determined by the
15 board of supervisors..
lg (d) Certain classifications in the Chico P~unicipal Court
17 are deemed to be equivalent or related in responsibility and
lg salary level to certain classifications in the service of Butte
lg County and whenever the salary of a classification in the service
20 of Butte County is adjusted by the board of supervisors, the
21 salary of equivalent classifications and related classifications
22 in the Chico I`:unicipal Court shall be adjusted an equal number. of
23 ranges on the currently effective salary schedule established by
2~ county ordinance. Such adjustments shall be effective on the
25 sane date as the effective date of the action by the board of
26 supervisors as it applies to classifications in the county service
27 but such adjustments shall be effective no longer than 90 days
28 after the final adjournment of-the next regular session of the
2~ Legislature.
30 All class relationships shall be based on salary schedule
31 range assign;nents effective Tiay 1, 1908.

flat salary in the no« superceded justice court, and they shall
commence their duties as marshal and deputy marshal in step-1
of their respective ranges.
Section 74942. OFFICERS AND ATTACI-IIaS; VACATIOIdS, SICI~
LEAVE AND 0 THER PRTVILEGES. ,The officers and attaches of the
municipal court shall be entitled to the same vacation, sick
leave and similar benefits and privileges as are granted to other
employees of the County of Butte by the salary-ordinance of said

Section 74943. DEP05IT OF FEES. All fees collected. by the
marshal or his deputies shall be deposited with the county

Section 74944. FULL-TIME PERFORMANCE OF DUTIES. All
officers and attaches~of the court shall devote their full time
to the performance of their dutiesr ~ -
Section 74945. LAW GOVERNING I~1ATTERS AFFECTING EMPLOYf~iiI~1T
OF OFFICERS A~TD ATTACHES. All matters affecting the employment
of such officers and attaches which are not specifically deter-
', mined by this article or other provision of state law shall be
governed and regulated by the then current salary ordinancE of the
County of Butte. l
Section 74946. EFFECTIVE DATE OF ARTICLE. This article
shall become effective on July 1, 1969, in that the Superior
Court of the State of California, in and for the County of Butte':
order in action D?o. 48971 is to be effective on July 1, 1969.
