4 ORDER ABANDONING ELTON AVENUE
5 WHEREAS, there has been filed with the Butte County
6 Planning Commission a petition requesting abandonment of"the
7 easement known as Elton Avenue as shown on the map of Biggs
8 Colony No .1, as recorded August 16, 1907, in Volume b of Maps,
9 page 88 in the office of the Recorder of the County of Butte,
10 State of California; and
11 WHEREAS, all abutting property owners have expressed
12 their written consent to such abandonment; and
13 G]HEREAS, said Elton Avenue has not been dedicated to the
14 public or acquired by eminent domain proceedings; and
15 WHEREAS, no public money h3 s been expended for th e
16 maintenance of said Elton Avenue within the past five consecutive
1'7 years; and
18 WHEREAS, said Elton Avenue has been impassable for
19 vehicular travel for the past five consecutive years,
20 NOW, THEREFORE, IT IS HEREBY ORDERED by the Board of

21 Supervisors of the County of Butte, State of California, as follows
22 1. That Elton Avenue, as it appears on the Map of Biggs
23 Colony No. 1, as recorded in Volume 6, page 88 of Maps, office of
24 the Recorder of the County of Butte, State of California, is
25 hereby abandoned.
2g 2. That the Clerk of this Board shall cause a certified
27 copy of this Order, attested by the Clerk with the seal of the
28 Board of Supervisors of the County of Butte, to be recorded in the
29 office of the Recorder of the County of Butte, State of California.
30 PASSED AND ADOPTED by the Board of Supervisors of the
31~ County of Butte, State of California, this 3rd day of June, 1959,
